Reactions of other contracting States and contracting organizations

Unless otherwise provided in the treaty or agreed by the contracting States and contracting organizations, a communication relating to a reservation to a treaty shall be transmitted:

An interpretative declaration that has been approved by all the contracting States and contracting organizations constitutes an agreement regarding the interpretation of the treaty.
يشكل الإعلان التفسيري الذي وافقت عليه جميع الدول والمنظمات المتعاقدة اتفاقا بشأن تفسير المعاهدة.

(i) if there is no depositary, directly by the author of the reservation to the contracting States and contracting organizations and other States and international organizations entitled to become parties to the treaty; or

If the reasons are not given, it is difficult for the author of a reservation, the other contracting States and contracting organizations or the judge who has to rule on the reservation to benefit from the assessment made by the author of the objection.

4.7.3 Effect of an interpretative declaration approved by all the contracting States and contracting organizations

An interpretative declaration that has been approved by all the contracting States and contracting organizations may constitute an agreement regarding the interpretation of the treaty.
يجوز أن يشكل الإعلان التفسيري الذي تكون جميع الدول المتعاقدة والمنظمات المتعاقدة قد وافقت عليه اتفاقا بشأن تفسير المعاهدة.

This makes it binding on all the contracting States and contracting organizations.
ومن ثم يكون مُلزِماً لجميع الدول والمنظمات المتعاقدة.

A reservation must be communicated in writing to the contracting States and contracting organizations and other States and international organizations entitled to become parties to the treaty.

A State or an international organization may not formulate a reservation to a treaty after expressing its consent to be bound by the treaty, unless the treaty otherwise provides or none of the other contracting States and contracting organizations opposes the late formulation of the reservation.
