Upon the expiration of a plan of work for exploration, the contractor shall apply for a plan of work for exploitation unless the contractor has already done so or has obtained an extension for the plan of work for exploration.
ولدى انقضاء مدة خطة عمل للاستكشاف، على المتعاقد أن يقدم طلبا بشأن خطة عمل للاستغلال ما لم يكن المتعاقد قد قام بذلك بالفعل أو حصل على تمديد لخطة العمــل الخاصة بالاستكشــاف.

However, the fact that a body such as the ECGD has paid a sum of money to a contractor does not prove that that contractor has suffered a loss in that or any amount for the purpose of maintaining a claim before the Commission.

114- هذا فضلا عن أنه عندما يكون المقاول قد حصل بالفعل على تعويض كلي أو جزئي من مثل هذه الهيئة في ما يتعلق بالخسائر التي تكبدها نتيجة لغزو العراق واحتلاله للكويت فإنه لم يعد هناك، في حدود هذا الكم من التعويض، أية خسارة يستطيع ذلك المقاول أن يطالب بها اللجنة.

It is an encouragement to the contractor to remedy defects appearing before or during the maintenance period. It also provides a fund out of which the employer can reimburse itself for defects that appear before or during the maintenance period which the contractor has, for whatever reason, failed or refused to make good.
وتؤدي أموال ضمان الأداء دورين؛ فهي تشجع المقاول على إصلاح العيوب التي تظهر قبل فترة الصيانة أو خلالها كما توفر مبلغاً يمكن لصاحب العمل أن يستخدمه ليعوض نفسه عن العيوب التي تظهر قبل فترة الصيانة أو خلالها والتي لا يصلحها المقاول أو يرفض إصلاحها لأي سبب من الأسباب.

ويوافق المجلس على طلبات التمديد بتوصية من اللجنة إذا كان المتعاقد قد بذل عن حسن نية جهودا للامتثال لشروط خطة العمل ولكنه لم يتمكن لأسباب خارجة عن إرادته من إنجاز الأعمال التحضيرية اللازمة للانتقال إلى مرحلــة الاستغلال أو إذا لم تُبرر الظروف الاقتصادية السائدة الانتقال إلى مرحلة الاستغلال.
