بصرف النظر عن أحكام المادة ٦، تنطبق هذه الاتفاقية فيما بين الناقل والمرسل إليه أو الطرف المسيطر أو الحائز الذي ليس طرفا أصيلا في مشارطة استئجار أو عقد نقل آخر مستبعد من نطاق انطباق هذه الاتفاقية.

If, after reasonable effort, the carrier is unable to locate the controlling party or the shipper, the carrier shall so advise the documentary shipper, and the documentary shipper shall give instructions in respect of the delivery of the goods;
وإذا ما تعذّر على الناقل، بعد بذل جهد معقول، تحديد مكان الطرف المسيطر أو مكان الشاحن، وجب على الناقل أن يُبلغ الشاحن المستندي بذلك، ووجب على الشاحن المُستندي أن يُصدر تعليمات بشأن تسليم البضاعة؛

If, after reasonable effort, the carrier is unable to locate the controlling party or the shipper, the carrier shall so advise the documentary shipper, and the documentary shipper shall give instructions in respect of the delivery of the goods;
وإذا تعذّر على الناقل، بعد بذل جهد معقول، تحديد مكان الطرف المسيطر أو الشاحن، وجب على الناقل أن يبلغ الشاحن المستندي بذلك، ووجب على الشاحن المستندي أن يصدر تعليمات بشأن تسليم البضاعة؛

According to paragraph 2 of this article, any term in the contract is void that excludes or limits the obligations and the liability of the shipper, the consignee, the controlling party or the documentary shipper.
20- وفقا للفقرة 2 من هذه المادة، يكون أي شرط في العقد باطلا إذا كان يستبعد واجبات ومسؤولية الشاحن أو المرسل إليه أو الطرف المسيطر أو الشاحن المستندي أو يحدّ منها.

Another view was expressed that paragraph 17.1 should not at all address the shipper, the controlling party, or the consignee.
وأُعرب عن رأي آخر بأن الفقرة 17-1 لا ينبغي أن تتطرّق إلى الشاحن أو الطرف المسيطر أو المرسل اليه.

It was observed that this construction could be interpreted to mean that the employees and agents of the shipper were included, but not the employees or agents of the controlling party or the consignee.
ولوحظ أنه يمكن تفسير هذه الصيغة على أنها تعني أن مستخدمي الشاحن ووكلاءه مشمولون ولكن ليس مستخدمي أو وكلاء الطرف المسيطر أو المرسل إليه.

62. As regards the consequences of failure by the controlling party or the shipper to provide the information sought by the carrier, the following possibilities were noted:
62- فيما يتعلق بعواقب عدم تقديم الطرف المسيطر أو الشاحن المعلومات التي يطلبها الناقل، أشير إلى الاحتمالات التالية:

(h) Act or omission of the shipper, the documentary shipper, the controlling party, or any other person for whose acts the shipper or the documentary shipper is liable pursuant to article 34 or 35;
(ح) فعل أو إغفال من جانب الشاحن أو الشاحن المستندي أو الطرف المسيطر أو أي شخص آخر يكون الشاحن أو الشاحن المستندي مسؤولا عن أعماله بمقتضى المادة 34 أو المادة 35؛

" Performing party " does not include any person that is retained, directly or indirectly, by a shipper, by a documentary shipper, by the consignor, by the controlling party or by the consignee instead of by the carrier.
لا يشمل " الطرف المنفِّذ " أي شخص يستعين به الشاحن أو الشاحن المستندي أو الطرف المسيطر أو المرسل إليه، لا الناقل، بصورة مباشرة أو غير مباشرة.

If, after reasonable effort, the carrier is unable to locatethe controlling party or the shipper, the carrier shall so advise the documentary shipper, and the documentary shipper shall give instructions in respect of the delivery of the goods. "
وإذا تعذّر على الناقل، بعد بذل جهد معقول، تحديد مكان الطرف المسيطر أو الشاحن، وجب على الناقل أن يبلغ الشاحن المستندي بذلك، ووجب على الشاحن المستندي أن يصدر تعليمات بشأن تسليم البضاعة. "

(f) It was not clear what might be the consequences of failure by the controlling party or the shipper to provide the information sought by the carrier; and
(و) ليس واضحا ما قد يترتب من عواقب على عدم تقديم الطرف المسيطر أو الشاحن المعلومات التي يطلبها الناقل؛

(b) The carrier might have the right to refuse to carry out instructions given under draft article 54 unless and until the controlling party or the shipper provided the information it sought pursuant to draft article 59.
(ب) قد يكون للناقل الحق في رفض تنفيذ التعليمات المقدمة بموجب مشروع المادة 54 ما لم يقدم الطرف المسيطر أو الشاحن المعلومات التي طلبها عملا بمشروع المادة 59 وإلى حين تقديم تلك المعلومات.

First, while the original text obliged the carrier to advise that the goods had not been claimed and imposed on the controlling party or the shipper the obligation to give instructions in respect of the delivery of the goods, the new text allowed the carrier to seek instructions but imposed no obligation on the shipper to provide them.
أولهما، أنّ النص الأصلي يُلزم الناقل بالإبلاغ عن أن البضاعة لم يُطالَب بها ويفرض على الطرف المسيطر أو الشاحن واجب تقديم تعليمات فيما يتعلق بتسليم البضاعة، بينما يسمح النص الجديد للناقل بالتماس التعليمات، ولكنه لا يفرض على الشاحن واجب تقديمها.

(h) Act or omission of the shipper, the documentary shipper, the controlling party, or any other person for whose acts the shipper or the documentary shipper is liable pursuant to article 33 or 34;
