أما النوع الثاني فيتمثل في الحكم التحوطي، ومن ذلك مثلاً الصيغة التالية: " ليس في هذه الاتفاقية ما يمس الحق السيادي للدول في استغلال وتنمية وإدارة مواردها الطبيعية " ().

Article 79 specifically states that “[N]othing in the present Convention shall affect the right of each State Party to establish the criteria governing admission of migrant workers and members of their families.”

6- ليس في هذه الاتفاقية ما يمس بالمبدأ القائل بأن توصيف الجرائم المقررة وفقا لهذه الاتفاقية وتوصيف الدفوع القانونية المنطبقة أو المبادىء القانونية الأخرى التي تحكم مشروعية السلوك محفوظ حصرا لقانون الدولة الطرف الداخلي، وبوجوب ملاحقة ومعاقبة تلك الجرائم وفقا لذلك القانون.

Nothing in this Convention shall affect the right of the Government of New Zealand to continue to distinguish as it considers appropriate in its laws and practice between persons according to the nature of their authority to be in New Zealand, including but not limited to their entitlement to benefits and other protections described in the Convention, and the Government of New Zealand reserves the right to interpret the Convention accordingly.
