٩ - يجوز للدولة الطرف أن ترفض التعاون بمقتضى هذه المادة إذا كانت الجريمة التي يتعلق بها الطلب لا تعد جريمة في إطار التنظيم الجنائي إذا ارتكبت ضمن نطاق ولايتها القضائية .

8. cooperation under this article or under article(s) ____ may be refused if the offence to which the request relates would not be an offence in the context of criminal organization if committed within its jurisdiction (Germany).
٨- يجوز للدولة الطرف رفض التعاون بمقتضى هذه المادة أو بمقتضى المادة )المواد( ـــــ إذا لم تكن الجريمة التي يتعلق بها الطلب تمثل جريمة في سياق التنظيم الجنائي إذا ارتكبت في إقليمها )ألمانيا(.

7. cooperation under this article may also be refused or provisional measures lifted if the requested State Party does not receive sufficient and timely evidence or if the property is of a de minimis value.
7- يجوز أيضا رفض التعاون بمقتضى هذه المادة أو إلغاء التدابير المؤقتة إذا لم تتلق الدولة الطرف متلقية الطلب أدلة كافية أو في حينها أو إذا كانت الممتلكات ذات قيمة لا يعتد بها.

7- إضافة إلى أحكام [الفقرتين 9 و21] من المادة [...] [المساعدة القانونية المتبادلة]، يجوز أيضا رفض التعاون بمقتضى هذه المادة أو إلغاء التدابير المؤقتة إذا لم تتلق الدولة الطرف متلقية الطلب أدلة كافية أو في حينها أو إذا كانت الممتلكات ذات قيمة لا يعتد بها.()

One delegation suggested that this paragraph should be clarified in respect of the phrase “an offence in the context of a criminal organization”.
٨ - يجوز للدولة الطرف أن ترفض التعاون بمقتضى هذه المادة اذا كانت الجريمة التي يتعلق بها الطلب لا تعد جريمة في اطار تنظيم اجرامي اذا ارتكبت ضمن نطاق ولايتها القضائية .اقترح أحد الوفود توضيح هذه الفقرة فيما يتعلق بعبارة " جريمة في اطار تنظيم اجرامي " .
