Welcoming the efforts of the Secretary-General and the Royal Government of Cambodia to conclude the negotiation of the draft agreement between the United Nations and the Royal Government of Cambodia concerning the Prosecution under Cambodian Law of Crimes Committed during the Period of Democratic Kampuchea contained in the annex to the present resolution,
وإذ ترحب بالجهود التي بذلها الأمين العام والحكومة الملكية لكمبوديا لاختتام التفاوض على مشروع الاتفاق بين الأمم المتحدة والحكومة الملكية لكمبوديا بشأن المقاضاة بموجب القانون الكمبودي على الجرائم المرتكبة خلال فترة نظام كمبودتشيا الديمقراطية الوارد في مرفق هذا القرار،

1. Approves the draft agreement between the United Nations and the Royal Government of Cambodia concerning the Prosecution under Cambodian Law of Crimes Committed during the Period of Democratic Kampuchea contained in the annex to the present resolution;
1 - توافق على مشروع الاتفاق بين الأمم المتحدة والحكومة الملكية لكمبوديا بشأن المقاضاة بموجب القانون الكمبودي على الجرائم المرتكبة خلال فترة نظام كمبودتشيا الديمقراطية الوارد في مرفق هذا القرار؛

2. Recommends that the Extraordinary Chambers should have subject-matter jurisdiction consistent with that set forth in the Law on the Establishment of the Extraordinary Chambers in the Courts of Cambodia for the Prosecution of Crimes Committed during the Period of Democratic Kampuchea;
2 - توصي بأن يكون للدوائر الاستثنائية اختصاص موضوعي يتماشى مع الاختصاص الوارد في القانون المتعلق بإنشاء دوائر استثنائية في محاكم كمبوديا لمحاكمة الجرائم المرتكبة خلال فترة حكم كمبوتشيا الديمقراطية؛

The Agreement between the United Nations and the Royal Government of Cambodia concerning the Prosecution under Cambodian Law of Crimes Committed during the Period of Democratic Kampuchea has been signed by both parties and is awaiting ratification through the Cambodian legislative process.

Welcoming in particular the promulgation of the Law on the Establishment of the Extraordinary Chambers in the Courts of Cambodia for the Prosecution of Crimes Committed during the Period of Democratic Kampuchea, and noting with appreciation the general provisions and competence of the Law and its provision for a role for the United Nations,

24. In 2003, the United Nations and the Government of Cambodia agreed to create Extraordinary Chambers in the Courts of Cambodia to try those who were most responsible for the Crimes Committed during the Period of Khmer Rouge rule from 1975 to 1979.
24- في عام 2003، اتفقت الأمم المتحدة وحكومة كمبوديا على إنشاء دوائر استثنائية في محاكم كمبوديا لمحاكمة الأشخاص الذين يتحملون أكبر قدر من المسؤولية عن الجرائم المرتكبة خلال فترة حكم الخمير الحمر من عام 1975 إلى عام 1979.

The mission reached " substantial " agreement with the Government Task Force on several issues, including on staffing and the sequencing of work to prepare for the phased establishment of the Extraordinary Chambers, which will prosecute Crimes Committed during the Period of Democratic Kampuchea under Cambodian law.

وفي 6 حزيران/يونيه 2003 تم التوقيع في فنوم بنه على الاتفاقية المبرمة بين الأمم المتحدة وحكومة كمبوديا بشأن المحاكمة على الجرائم المرتكبة خلال فترة جمهورية كمبوديا الديمقراطية بموجب قانون كمبوديا.

I have the honour to refer to General Assembly resolution 57/228 of 18 December 2002, in which the General Assembly requested me to resume negotiations, without delay, to conclude an agreement with the Government of Cambodia on the establishment of Extraordinary Chambers within the existing court structure of Cambodia for the prosecution of Crimes Committed during the Period of Democratic Kampuchea.

In the latter paragraph, the General Assembly welcomed, in general terms, the promulgation on 10 August 2001 of the Law on the Establishment of the Extraordinary Chambers in the Courts of Cambodia for the Prosecution of Crimes Committed during the Period of Democratic Kampuchea, which gives expression to this conception.

G. Khmer Rouge trials 69. The agreement between the United Nations and the Government of Cambodia concerning the prosecution under Cambodian law of Crimes Committed during the Period of Democratic Kampuchea was signed in Phnom Penh on 6 June 2003, following a process of negotiation that took several years.
69 - عقب مفاوضات استغرقت سنوات عديدة، وقعت الأمم المتحدة في 6 حزيران/يونيه 2003 مع الحكومة الكمبودية في بنوم بنه الاتفاقية المتعلقة بمحاكمة الجرائم المرتكبة خلال فترة نظام كمبوتشيا الديمقراطية بموجب القانون الكمبودي.

The present report describes the steps that I took to resume negotiations with the Government of Cambodia for an agreement on the establishment of Extraordinary Chambers within the existing court structure of Cambodia for the prosecution of Crimes Committed during the Period of Democratic Kampuchea.
79 - يصف هذا التقرير الخطوات التي اتخذتها لاستئناف المفاوضات مع حكومة كمبوديا للتوصل إلى اتفاق بشأن إنشاء دوائر استثنائية داخل نطاق الهيكل الحالي للمحاكم في كمبوديا، وذلك لاتخاذ إجراءات المقاضاة اللازمة بشأن الجرائم التي ارتكبت إبان فترة حكم كمبوتشيا الديمقراطية.

The Government has also made efforts, in agreement with the United Nations, to establish the Extraordinary Chambers in the Courts of Cambodia for the prosecution of Crimes Committed during the Period of Democratic Kampuchea.
كما أن الحكومة بذلت جهوداً، بالاتفاق مع الأمم المتحدة، من أجل إنشاء دوائر استثنائية في محاكم كمبوديا للمحاكمة على الجرائم التي ارتكبت خلال فترة كمبوتشيا الديمقراطية.

In his subsequent reports on the Khmer Rouge trials (A/58/617, A/59/432 and Add.1, A/60/565, A/62/304 and A/67/380), the Secretary-General provided updates on the progress achieved towards establishing and operating the Extraordinary Chambers in the Courts of Cambodia, within the Cambodian domestic courts, for the prosecution under Cambodian law of Crimes Committed during the Period of Democratic Kampuchea.

43. The Office continued to maintain a watching brief on preparations for the trials of senior leaders of the Khmer Rouge and those most responsible for Crimes Committed during the Period of Democratic Kampuchea.
