Having concluded its consideration of communication No. 377/1989, submitted to the Human Rights Committee by Mr. Anthony Currie under the Optional Protocol to the International Covenant on Civil and Political Rights,

The failure to provide Mr. Currie an effective right to appeal without undue delay in accordance with article 14, paragraphs 3 (c) and 5, of the Covenant, means that he did not receive a fair trial within the meaning of the Covenant.
وإن عدم توفير حق الاستئناف بصورة فعالة للسيد كوري دون تأخير لا موجب له، وفقا للفقرتين ٣ )ج( و ٥ من المادة ١٤ من العهد، يعني أنه لم يحصل على محاكمة عادلة ضمن المدلول الذي حدده العهد.

82. Mr. Currie (Canada) said that Canada agreed that the objectives of the proposed framework for a draft convention or protocol on transboundary aquifer systems (protection of aquifers, bilateral cooperation, and shared information) were important.

The author refers to the Committee's decisions in Thomas v. Jamaica and Currie v. Jamaica, in which the Committee found that the failure to file a constitutional motion to the Supreme Court of Jamaica owing to lack of financial means and the unavailability of legal aid was not an obstacle to admissibility.
