In the event enforcement is requested at the time the limitation (prescription) period has expired, the debtor may raise the objection that the statutory limitation period has expired and the court will then refuse to decide and carry out the enforcement.
وفى حالة تقديم طلب للإنفاذ في وقت تكون فيه فترة التقادم قد انقضت، يجوز للمدين أن يثير اعتراضا بأن فترة التقادم قد انقضت وحينئذ سترفض المحكمة البت في الأمر والإنفاذ.

After notification, the debtor may discharge its obligation only by paying the assignee or as instructed by the assignee.
7- وبعد الاشعار، لا يجوز للمدين أن يبرئ ذمته من التزامه الا بالسداد الى المحال اليه أو وفقا لتعليمات المحال اليه.

A competition between the transferee of a claim and a creditor that is collecting the claim is viewed as a priority competition, even though the debtor may not yet be in default towards the collecting creditor.
ويعتبر التنافس بين من تنقل إليه مطالبة ودائن يسعى لتحصيل المطالبة تنافسا على الأولوية، رغم أن المدين قد لا يكون مقصرا بعد تجاه الدائن المحصّل.

1. In a claim by the assignee against the debtor for payment of the assigned receivable, the debtor may raise against the assignee all defences and rights of set-off arising from the original contract, or any other contract that was part of the same transaction, of which the debtor could avail itself as if the assignment had not been made and such claim were made by the assignor.
1 - عندما يطالب المحال إليه المدين بسداد المستحق المحال، يجوز للمدين أن يتمسك تجاه المحال إليه بكل ما ينشأ عن العقد الأصلي، أو أي عقد آخر يشكل جزءا من المعاملة ذاتها، من دفوع وحقوق مقاصة كان يمكن للمدين أن يتمسك بها وكأن تلك الإحالة لم تُجر وكانت تلك المطالبة صادرة عن المحيل.

If, however, the debtor pays the assignee before obtaining performance by the assignor, the debtor may not recover from the assignee the sums paid but is left with any remedies available under the applicable law against the assignor.
بيد أنه إذا دفع المدين الى المحال اليه قبل قيام المحيل بالأداء، فإنه لا يجوز للمدين أن يسترد من المحال اليه المبالغ المدفوعة، ولكنه يحتفظ بحق اتخاذ أي اجراءات انتصاف متاحة بمقتضى القانون المنطبق ضد المحيل.

3 - بصرف النظر عن أحكام الفقرتين 1 و 2 من هذه المادة، لا تكون الدفوع وحقوق المقاصة التي يجوز للمدين أن يتمسك بها تجاه المحيل بمقتضى المادة 9 أو 10، بسبب الإخلال بأي اتفاق يقيّد بأي شكل من الأشكال حق المحيل في إجراء الإحالة، متاحة للمدين تجاه المحال إليه.

1. The debtor may agree with the assignor in a writing signed by the debtor not to raise against the assignee the defences and rights of set-off that it could raise pursuant to article 18.
1 - يجوز للمدين أن يتفق مع المحيل، بكتابة موقَّعة من المدين، على عدم التمسك تجاه المحال إليه بالدفوع وحقوق المقاصة التي كان يمكنه أن يتمسك بها بمقتضى المادة 18.

2. The debtor may not waive defences:

As article 20 does not grant to the debtor a right of set-off if, under law applicable outside the draft Convention, the debtor does not have such a right, the debtor may not have any right of set-off in such jurisdictions.
ونظر لأن المادة 20 لا تمنح المدين حقا في المقاصة اذا لم يكن يتمتع بهذا الحق بمقتضى القانون المنطبق خارج نطاق الاتفاقية، فإن المدين قد لا يتمتع بأي حق في المقاصة في مثل هذه النظم القضائية.

" 1. The law should provide that, except as otherwise provided in recommendations 14, 109, 129-132, 202-211 and 213-222, the secured creditor and the grantor or the debtor may derogate from or vary by agreement its provisions relating to their respective rights and obligations.
