2. To declare illegal and prohibit organizations, and also organized and all other propaganda activities, which promote and incite racial discrimination, and to recognize participation in such organizations or activities as an offence punishable by law;
2- إعلان عدم شرعية المنظمات، وكذلك النشاطات الدعائية المنظمة وسائر النشاطات الدعائية، التي تقوم بالترويج للتمييز العنصري والتحريض عليه، وحظر هذه المنظمات والنشاطات، واعتبار الاشتراك في أيها جريمة يعاقب عليها القانون؛

In the context of the view of some States that in their legal order it is inappropriate to declare illegal an organization before its members have promoted or incited racial discrimination, the Committee reiterated its position that such " organizations, as well as organized and other propaganda activities, have to be declared illegal and prohibited.
وفي سياق وجهة نظر بعض الدول التي مؤداها أنه من غير الملائم في نظامها القانوني إعلان عدم شرعية منظمة ما قبل أن يقوم أعضاؤها بالتشجيع على التمييز العنصري أو التحريض عليه، أعادت اللجنة تأكيد موقفها القائل بأنه " لا بد من إعلان عدم شرعية المنظمات والنشاطات المنظمة والنشاطات الدعائية الأخرى وحظرها.

(b) Shall declare illegal and prohibit organizations, and organized and all other propaganda activities, that promote and incite racial discrimination, and shall recognize participation in such organizations or activities as an offence punishable by law;
(ب) إعلان المنظمات والأنشطة الدعائية المنظمة وجميع الأنشطة الدعائية الأخرى التي تروج للتمييز العنصري وتحرض عليه منظمات وأنشطة غير مشروعة وحظرها واعتبار المشاركة في منظمات أو أنشطة من هذا القبيل جريمة يعاقب عليها القانون؛

153. The Committee recommends that the Government take further preventive measures to counter racist violence and to implement fully article 4 of the Convention, which obliges States parties to declare illegal and prohibit organizations which promote and incite racial discrimination.
١٥٣ - وتوصي اللجنة بأن تتخذ الحكومة تدابير وقائية أخرى لمقاومة العنف العنصري وللتنفيذ الكامل للمادة ٤ من الاتفاقية، وهي المادة التي تلزم الدول اﻷطراف بإعلان لا شرعية المنظمات التي تشجع وتحرض على التمييز العنصري وبحظرها.

164. With regard to article 4 of the Convention, the members of the Committee noted that only press offences were mentioned in the report and not all the other offences that should be punishable, inasmuch as the Convention required States to declare illegal and to prohibit organizations and propaganda activities which incited racial discrimination.
١٦٤ - وفيما يتعلق بالمادة ٤ من الاتفاقية، لاحظ أعضاء اللجنة أنه لم تذكر في التقرير غير جرائم الصحافة لا كل الجرائم اﻷخرى التي تستوجب العقاب، من حيث أن الاتفاقيــــة تطلب إلى الدول إعلان لا قانونية المنظمات واﻷنشطة الدعائية التي تحرض على التمييز العنصري وحظرها.

Article 4 (a) of the Convention provides that State parties " shall declare an offence punishable by law all dissemination of ideas based on racial superiority or hatred incitement to racial discrimination " and article 4 (b) provides that States parties " shall declare illegal and prohibit ... organized and all other propaganda activities, which promote and incite racial discrimination " .
وجاء في نص المادة 4(أ) من هذه الاتفاقية أن على الدول الأطراف " اعتبار كل نشر للأفكار القائمة على التفوق العنصري أو الكراهية العنصرية، وكل تحريض على التمييز العنصري .... جريمة يعاقب عليها القانون " ، وجاء في نص المادة 4(ب) أن على الدول الأطراف " إعلان عدم شرعية ....
