It recalled, in regard to all other Covenant rights, that any measures derogating from the provisions of the Covenant must be in accordance with that article in all cases, and underlined the exceptional and temporary nature of any such derogations.
وذكَّرت فيما يتعلق بجميع الحقوق الأخرى المذكورة في العهد بأن أي تدابير تقيد أحكام العهد يجب أن تتفق مع تلك المادة في جميع الحالات، وأن تبرز الطابع الاستثنائي والمؤقت لأي تقييد من هذا القبيل.

Nothing in the present Declaration shall be construed as impairing or contradicting the purposes and principles of the Charter of the United Nations nor as restricting or derogating from the provisions of the Universal Declaration of Human Rights, the International Covenants on Human Rights and other international instruments and commitments applicable in this field.
ليس في هذا اﻹعلان ما يمكن تأويله على نحو يخل بمقاصد ومبادئ ميثاق اﻷمم المتحدة أو يتعارض معها، أو يقيد أو ينتقص من أحكام اﻹعلان العالمي لحقوق اﻹنسان والعهدين الدوليين الخاصين بحقوق اﻹنسان والصكوك والالتزامات الدولية اﻷخرى المنطبقة في هذا الميدان.

9. Furthermore, article 4, paragraph 1, requires that no measure derogating from the provisions of the Covenant may be inconsistent with the State party's other obligations under international law, particularly the rules of international humanitarian law.
9- وعلاوة على ذلك، تشترط الفقرة 1 من المادة 4 عدم منافاة أي من التدابير التي لا تتقيد بأحكام العهد لالتزامات الدولة الأخرى بمقتضى القانون الدولي، لا سيما قواعد القانون الإنساني الدولي.

Article 4, paragraph 1, contained a special clause which made it clear that the obligation not to discriminate existed even in such circumstances and in relation to measures derogating from the provisions of the Covenant.

Referring to its general comment No. 29, the Committee reiterates that measures derogating from the provisions of the Covenant must be of an exceptional and temporary nature and be limited to the extent strictly required.
أكدت اللجنة، في إشارة إلى تعليقها العام رقم 29، أن التدابير التي تخالف أحكام العهد يجب أن تكون استثنائية ومؤقتة وأن تقتصر على الحد الأقصى الذي تقتضيه الضرورة.

Nothing in this Declaration shall be construed as impairing, contradicting, restricting or derogating from the provisions of the Charter of the United Nations and the Universal Declaration of Human Rights, any other international instrument or national laws adopted in furtherance of these instruments.
18 - ليس في هذا الإعلان ما يجوز تفسيره بأنه ينتقص من أحكام ميثاق الأمم المتحدة والإعلان العالمي لحقوق الإنسان أو من أي صك دولي آخر أو قوانين وطنية اعتمدت من أجل تعزيز هذين الصكين، أو يتناقض معها أو يقيدها أو يبطلها.

In relation to the mutually reinforcing nature of international human rights law and international humanitarian law, the Committee indicated, for example, that the Covenant requires that no measure derogating from the provisions of the Covenant may be inconsistent with the State party's other obligations under international law, particularly the rules of international humanitarian law.
وفيما يتعلق بالتعزيز المتبادل بين القانون الدولي لحقوق الإنسان والقانون الإنساني الدولي، أشارت اللجنة، على سبيل المثال، إلى أن العهد يشترط عدم تعارض أي من التدابير التي لا تتقيد بأحكام العهد مع الالتزامات الأخرى الواقعة على الدولة الطرف بمقتضى القانون الدولي، لا سيما قواعد القانون الإنساني الدولي.

Mr. SCHEININ said that his text was intended to clarify what was meant by the reference in article 4 to other international obligations preventing a State party from using that article as a basis for derogating from the provisions of the Covenant.
6- السيد شاينين قال إن نصه يهدف إلى إيضاح سبب الإشارة في المادة 4 إلى الالتزامات الدولية الأخرى التي تمنع أية دولة طرف من استخدام تلك المادة كأساس لتقييد أحكام العهد.
