Under these circumstances, it has to be recognized that the detention is arbitrary because it is in violation of the general principle of criminal and procedural law non bis in idem under category III of the principles approved by the Group for the consideration of cases; it involves such a serious breach of the norms governing due process of law as to make the detention arbitrary.
