The report describes encouraging trends towards the reduction of pretrial detention and detention for children and the growing use of prevention, diversion, restorative justice and alternatives to imprisonment, while underscoring that much progress remains to be made.

The Decree on alternatives to detention for children in conflict with the law.
اعتماد المرسوم المتعلق بالتدابير البديلة لاحتجاز الأطفال المخالفين للقانون.

(a) Welcome the measures adopted by States to reduce the use of detention, including pretrial detention, for children in conflict with the law;
(أ) الترحيب بالتدابير التي اعتمدتها الدول من أجل تقليل اللجوء إلى احتجاز الأطفال المخالفين للقانون، بما في ذلك احتجازهم قبل المحاكمة؛

(b) Avoid the use of pretrial detention for children and ensure that, when applied, this is kept to a minimum period of time;
(ب) تجنب اللجوء إلى احتجاز الأطفال رهن المحاكمة، وضمان أن يكون هذا الاحتجاز قصيراً قدر الإمكان في حال اللجوء إليه؛

Conditions of detention for children in conflict with the law, including in police stations while under arrest and in detention centres, are often poor and inadequate, in some cases amounting to cruel, inhuman or degrading treatment.
46- إن ظروف احتجاز الأطفال المخالفين للقانون في أماكن منها مخافر الشرطة، أثناء التوقيف، ومراكز الاحتجاز كثيراً ما تكون متدنية وغير ملائمة()، وتبلغ في بعض الحالات حد المعاملة القاسية أو اللاإنسانية أو المهينة().

5. Encourages Member States to promote, inter alia, the use of alternative measures, such as diversion and restorative justice, to comply with the principle that deprivation of liberty of children should be used only as a measure of last resort and for the shortest appropriate period of time, and to avoid, wherever possible, the use of pretrial detention for children;
5- تشجِّع الدولَ الأعضاء على أن تقوم، في جملة أمور، بتعزيز استخدام تدابير بديلة مثل إحالة الجانحين إلى برامج إصلاح خارج نظام العدالة الجنائية والعدالة الإصلاحية، والتقيد بمبدأ وجوب عدم حرمان الأطفال من حرّيتهم إلاَّ كتدبير يُلجأ إليه كملاذ أخير ولأقصر فترة زمنية ممكنة والحرص، حيثما أمكن، على تفادي احتجاز الأطفال قبل المحاكمة؛

This should be undertaken for all professional groups working for and with children, such as judges, lawyers, law enforcement officials, armed and security forces, journalists, civil servants, personnel working in institutions and places of detention for children, teachers, health-care personnel, including psychologists, and social workers.
وينبغي إتاحة هذه البرامج لجميع الفئات المهنية التي تعمل لصالح الأطفال ومعهم، كالقضاة والمحامين والموظفين المكلفين بإنفاذ القانون والقوات المسلحة وقوات الأمن والصحفيين وموظفي الخدمة المدنية والموظفين العاملين في المؤسسات الإصلاحية وأماكن احتجاز الأطفال والمدرسين والعاملين في مجال الرعاية الصحية، بمن فيهم أخصائيو الطب النفسي والأخصائيون الاجتماعيون.

It also recommends to the State party that it undertake systematic education and training on the rights of the Convention for children and their parents, as well as all professional groups working for and with children, in particular parliamentarians, judges, magistrates, lawyers, law enforcement officials, civil servants, personnel working in institutions and places of detention for children, teachers, health personnel and social workers.
وتوصي أيضاً الدولة الطرف بالاضطلاع ببرامج للتثقيف والتدريب المنتظم بخصوص الحقوق التي تكفلها الاتفاقية للأطفال والآباء والأمهات، وكذلك جميع الفئات المهنية التي تعمل مع الأطفال ولصالحهم، ولا سيما البرلمانيين والقضاة والمحامين وموظفي إنفاذ القانون وموظفي الدولة والعاملين في مؤسسات احتجاز الأطفال والمعلمين والعاملين في مجال الصحة، والأخصائيين الاجتماعيين.

19. In 2001, CRC expressed concern at the extremely poor conditions of detention for children, amounting in many instances to cruel, inhuman and degrading treatment as spelled out in article 37 (a) of the Convention.
19- وفي عام 2001، أعربت لجنة حقوق الطفل عن قلقها إزاء ظروف احتجاز الأطفال البالغة السوء التي تعتبر في حالات كثيرة بمثابة معاملة قاسية أو لا إنسانية أو مهينة على النحو الموضح في المادة 37(أ) من الاتفاقية(64).

30. In Egypt, the Prosecutor General had issued an instruction to all prosecutors regarding, inter alia, cooperation with the child protection committees, the prohibition of pretrial detention for children under age 15, the role of prosecutors in inspection and monitoring with respect to unlawful arrest and detention and the use of child-friendly interrogation techniques for all children.
30- وفي مصر، أصدر المدعي العام تعليمات لجميع أعضاء النيابة العامة بشأن جملة أمور منها إقامة التعاون مع لجان حماية الطفولة وحظر احتجاز الأطفال دون سن الخامسة عشرة قبل المحاكمة والدور المنوط بأعضاء النيابة العامة في تفقّد ورصد حالات التوقيف والاحتجاز غير القانونية واستخدام أساليب الاستجواب الملائمة للطفولة مع جميع الأطفال.
