وعليه، ترى اللجنة أن الوقائع المعروضة عليها لا تبين أن قرارات المحاكم كانت واضحة التعسف أو بلغت حد الخطأ القضائي. وترى أيضاً أن الوقائع على النحو الذي عُرضت به لا تكشف عن انتهاك الدولة الطرف المادة 2، مقترنة بالمادة 5، من الاتفاقية.

The Committee is of the view that the facts before it disclose a violation by the State party of article 7 of the Covenant, and that the use of the contested confession in court as grounds for a conviction for murder also constitutes a violation of articles 14, paragraph 3 (g), and 6, paragraph 2, of the Covenant.
