The courts are the judicial bodies competent to adjudicate in all disputes and offences.
والمحاكم هي الجهات القضائية التي تختص بالفصل في جميع المنازعات والجرائم.

Under the terms of article 49: " Without prejudice to the provisions of article 53 hereof, the courts shall be competent to adjudicate in all disputes and offences " ;
وتنص المادة 49 منه على الآتي: " مع مراعاة ما ورد في المادة 53 من هذا النظام تختص المحاكم في الفصل في جميع المنازعات والجرائم " ؛

30. Article 26 of the Statutes of the Judiciary further stipulates that the courts are competent to hear all disputes and offences except those excluded, by law, from their jurisdiction.
30- كما نصت المادة 26 من نظام القضاء على اختصاص المحاكم بنظر المنازعات والجرائم إلا ما يستثنى بنظام.

(a) The competence of the courts to adjudicate in all disputes and offences, unless otherwise stipulated by a specific enactment, is defined by law (articles 1-15 of the Act);
(أ) اختصاصات المحاكم محددة، طبقا للقانون، بالفصل في كافة المنازعات والجرائم إلا ما استُثني بنص خاص (المادتان 1 و15 من القانون)؛

24. In accordance with article 49 of the Basic Law of Government: " Without prejudice to the provisions of article 53 hereof, the courts shall be competent to adjudicate in all disputes and offences. "
24- بموجب المادة 49 من النظام الأساسي للحكم التي نصها " مع مراعاة ما ورد في المادة 53 من هذا النظام تختص المحاكم في الفصل في جميع المنازعات والجرائم ... " .

13. Article 8 of the Judicial Authority Act No. 1 of 1990 also stipulates that: " The courts are the judicial bodies which are competent to render judgement in regard to all disputes and offences. "
13- كما نصت المادة 8 من قانون السلطة القضائية رقم 1 لسنة 1990 أن " المحاكم هي الجهات القضائية التي تختص بالفصل في جميع المنازعات والجرائم " . الفقرة 3(ج)

Article 26 of the Statutes of the Judiciary defines the jurisdiction of the sharia courts as follows: " The courts shall be competent to adjudicate in all disputes and offences except those excluded, by law, from their jurisdiction. "
وحددت المادة 26 ولاية المحاكم الشرعية بالآتي: " تختص المحاكم بالفصل في كافة المنازعات والجرائم إلا بما يستثنى بنظام ... " .

كما أكدت ذلك المادة 26 من نظام القضاء حيث تنص على أن " تختص المحاكم بالفصل في كافة المنازعات والجرائم إلا ما يستثنى بنظام ... " .

In conformity with the provisions of article 5 of the Convention chapter III of the Yemeni Constitution defines the role of the judicial authority. Article 147 of the Constitution reads as follows: " The judicial authority has judicial, financial and administrative independence and the Department of Public Prosecutions is one of its subsidiary bodies. The courts are responsible for rendering judgment in all disputes and offences.
66- تنفيذاً لأحكام هذه النصوص القانونية الواردة في هذه المادة، فقد أكد دستور البلاد في الفصل الثالث منه على دور السلطة القضائية طبقاً لما ورد في المادة 147 التي تنص على أن لقضاء سلطة مستقلة قضائياً ومالياً وإدارياً وأن النيابة العامة هي هيئة من هيئاته وتتولى المحاكم الفصل في جميع المنازعات والجرائم.

(c) The courts of law are regulated by the Statutes of the Judiciary, promulgated in Royal Decree No. M/64 of 14 Rajab 1395 A.H., which specify the jurisdiction of the courts. Article 26 of the statutes stipulates: " The courts shall be competent to adjudicate in all disputes and offences except those excluded, by law, from their jurisdiction. "
(ج) نظام القضاء الصادر بالمرسوم الملكي رقم (م/64) بتاريخ 14/7/1395 ه، ويختص بتنظيم المحاكم، ويبين اختصاص المحاكم الشرعية كما في المادة 26 التي تنص على الآتي: " تختص المحاكم بالفصل في كافة المنازعات والجرائم إلا ما يستثنى بنظام ... " .
