The Committee considers that, although restrictions on freedom of expression and on the dissemination of information and ideas of all kinds in print may be established by law for reasons of public morals, such restrictions cannot lead to disregard for the right provided for in article 19, paragraph 2, of the Covenant.

(c) Such a ban on the organization of peaceful assembly is not necessary in a democratic society, the cornerstone of which is free dissemination of information and ideas not necessary favourably received by the government or the majority of the population.
(ج) لا يشكل هذا الحظر على تنظيم تجمع سلمي أمراً له دواعيه في مجتمع ديمقراطي، تسوده حرية نشر المعلومات والأفكار التي لا تتقبلها بالضرورة الحكومة أو غالبية السكان().

ولا يجوز للمحكمة المختصة منع نشر المعلومات والأفكار عبر وسائل الإعلام العامة إلا إذا لزم ذلك من أجل منع الدعوة إلى تدمير النظام الذي يحدده الدستور بالقوة؛ والحفاظ على السلامة الإقليمية لجمهورية الجبل الأسود؛ ومنع الترويج للحرب أو التحريض على العنف أو ارتكاب جرائم جنائية؛ ومنع نشر الكراهية أو التمييز على أسس عنصرية وقومية ودينية " .
