diyah (payment of blood money) also limited the application of capital punishment, in that the victim's relatives could request that the killer not be executed but pay fidyah (a ransom).
وتحد الدية أيضاً من تطبيق عقوبة الإعدام، حيث إنه يمكن لأقارب الضحية أن يطلبوا عدم إعدام المحكوم عليه، وإنما دفع فدية.

Article 32 stipulates that the right of a person or his heirs to indemnity for bodily injury (diyah) or for the shedding of blood (arsh) shall not be abandoned and that the indemnity shall be payable by the group which shares the liability of its members in such cases (al-`aqilah).

ويعاقب بالحبس مدة لا تقل عن ثلاث سنوات ولا تزيد على عشر سنوات إذا اقترن فعل النقل بأعمال اعتداء جنسي، أو إيذاء جسدي دون أن يخل ذلك بأحكام الحدود والقصاص والدية والأرش على حسب الأحوال.

In addition, the Special Representative is informed that, in practice, where the victim is a nonMuslim, there is no diyah.

In their comments on this report, the authorities reported that 125 individuals had been spared from execution in 2013, after the Government had mediated diyah settlements, or clemency.

112. Article 32 of the Code provides that the right of a person or his heirs to indemnity for bodily injury (diyah) or for the shedding of blood (arsh) shall not be abandoned.
١١٢- واشترطت المادة ٣٢ من القانون عدم إهدار الحق الشخصي أو ورثته في الدية أو الأرش.

If the abduction is accompanied or followed by bodily harm, assault or torture, the penalty is increased to a term of up to 10 years' imprisonment, without prejudice to the right to retribution (qisas) or indemnity for bodily injury (diyah) or for the shedding of blood (arsh), as the case may be, if such is warranted by the harm caused.
وإذا صاحب الخطف أو تلاه إيذاء أو تعذيب أو اعتداء تتضاعف عقوبة الحبس لمدة لا تزيد عن عشر سنوات كاملة، دون إخلال بالقصاص أو الدية أو الأرش، على حسب الأحوال، إذا ترتب على الإيذاء ما يقتضي ذلك.

The concept of diyah is a complex one and the Special Representative treads in this area with reluctance.
34- إن مفهوم الدية مفهوم مُعقد يتردد الممثل الخاص في معالجته في هذا المجال.

It is understood that the relatives of the victim can pardon the murderer or demand the payment of diyah (blood money) instead.
ومن المفهوم أن أقارب الضحية بإمكانهم العفو عن مرتكب جريمة القتل أو مطالبته بدفع الدية (بدل الدم) عوضاً عن ذلك.

However, where the perpetrator is a male and the victim was a female, it is the relatives of the victim that have to pay to the perpetrator half the appropriate diyah for the offence before exacting revenge, that is before the murderer is executed.
غير أنه متى كان مرتكب الجريمة ذكراً وكانت الضحية أنثى فإنه على أقارب الضحية أن يدفعوا لمرتكب الجريمة نصف الدية الملائمة للجريمة قبل المطالبة بالثأر، أي قبل تنفيذ الإعدام في القاتل.

The full amount of diyah is due " only where the victim is a Muslim, of the male sex and of freeborn status.
إذ لا يستحَق كامل قيمة الدية " إلا حينما يكون المجني عليه مسلماً ذكراً ومولوداً حراً.

This principle will be applied to murder offences, in accordance with the provisions on qisas (retribution) and diyah (payment of blood money) in the Retribution Act No. 6 of 1993, as amended, and with the Great Green Document on Human Rights, the eighth principle of which states:
