The Committee has found a direct violation of article 6 of the Covenant, in concluding that the State Party has failed in its duty to guarantee the right to life of Djamel and Mourad Chihoub.
خلصت اللجنة إلى وجود انتهاك مباشر للمادة 6 من العهد مستنتجة أن الدولة الطرف لم تف بالتزامها بضمان الحق في الحياة لمراد وجمال شيهوب.

The Committee noted that the State party had not provided any information to refute those allegations and concluded that the State party had failed in its duty to guarantee the right to life of Djamel and Mourad Chihoub, in violation of article 6 of the Covenant.
ولاحظت اللجنة أن الدولة الطرف لم تقدم أي معلومات يمكن أن تدحض هذه الادعاءات، وخلصت إلى أن الدولة الطرف أخلت بالتزامها بضمان حق مراد وجمال شيهوب في الحياة، منتهكة بذلك المادة 6 من العهد.

The Committee therefore concludes that the facts before it reveal a violation of article 2, paragraph 3, of the Covenant, read in conjunction with articles 6, paragraph 1; 7; 9; 10, paragraph 1; and 16 of the Covenant with regard to Djamel and Mourad Chihoub, and read in conjunction with article 24 of the Covenant with regard to Mourad Chihoub.
وتخلص اللجنة إلى أن الوقائع المعروضة عليها تكشف انتهاكاً للفقرة 3 من المادة 2 مقروءة بالاقتران مع الفقرة 1 من المادة 6، والمادتين 7 و9 والفقرة 1 من المادة 10، والمادة 16 من العهد، فيما يتعلق بمراد وجمال شيهوب، وبالاقتران مع المادة 24 من العهد، فيما يتعلق بمراد شيهوب.

The Committee notes that the State party has not provided any information to refute these allegations, and concludes that the State party has failed in its duty to guarantee the right to life of Djamel and Mourad Chihoub, in violation of article 6 of the Covenant.
وتلاحظ اللجنة أن الدولة الطرف لم تقدم أي معلومات يمكن أن تدحض هذه الادعاءات، وتخلص إلى أن الدولة الطرف أخلت بالتزامها بضمان حق مراد وجمال شيهوب في الحياة، منتهكة بذلك المادة 6 من العهد().

1. I fully agree with the decision of the Human Rights Committee in the case of Chihoub v. Algeria, communication No. 1811/2008, and with the finding of violations of the human rights of Djamel and Mourad Chihoub and of their parents Taous Djebbar and Saadi Chihoub resulting from the enforced disappearance of the former.
1- أتفق تماماً مع قرار اللجنة المعنية بحقوق الإنسان التي خلصت إلى حدوث انتهاكات لحقوق الإنسان في قضية شيهوب ضد الجزائر (البلاغ رقم 1811/2008)، والتي بينت فيه اللجنة أن الوقائع المثبتة تكشف عن انتهاكات لحقوق الإنسان وقع ضحيتها كل من مراد وجمال شيهوب ووالديهما، طاوس جبار والسعدي شيهوب، بسبب الاختفاء القسري للابنين.
