A neighbour who heard that the soldiers were looking for " Kamel the taxi driver " directed them to the Djebrouni family home.
ولما سمع هذا الجار أن عناصر الجيش يطلبون " كمال سائق التاكسي " ، دلّهم على باب شقة عائلة جبروني.

Once that period had elapsed, his family approached various courts in Algiers to find out whether Kamel Djebrouni had been brought before a prosecutor.
وبعد انقضاء هذه المدة، قامت أسرة الضحية بعدة مساعي لدى مختلف محاكم العاصمة لمعرفة ما إذا كان كمال جبروني قد قُدّم إلى مدع عام لمحاكمته.

With regard to article 9, paragraph 1, the author recalls that Kamel Djebrouni was arrested without a warrant and without being informed of the reasons for his arrest.
وفيما يتعلق بالفقرة 1 من المادة 9، تذكّر صاحبة البلاغ بأن كمال جبروني أُلقي القبض عليه دون أمر قضائي ودون إبلاغه بأسباب اعتقاله.

Recalling that incommunicado detention may constitute per se a violation of article 9, paragraph 3, the author concludes that this provision was violated in Kamel Djebrouni's case.
وبعد التذكير بأن الحبس في مكان سري قد يؤدي في حد ذاته إلى انتهاك للفقرة 3 من المادة 9، خلصت صاحبة البلاغ إلى أن أحكام هذه الفقرة قد انتهكت في حالة كمال جبروني.

The authorities even denied that State agencies were involved in Kamel Djebrouni's disappearance, even though the victim's entire family and some neighbours witnessed his abduction.
وقد وصل الأمر بالسلطات إلى نفي أي تورط لمصالح الدولة في اختفاء كمال جبروني رغم أن جميع أفراد الأسرة وبعض الجيران كانوا شهوداً عند اختطافه.

However, no action was taken despite several attempts by Kamel Djebrouni's family to alert the authorities to his disappearance. All their efforts were in vain.
على أن ذلك لم يحدث، بينما قامت أسرة كمال جبروني من جهتها بعدة خطوات لإبلاغ السلطات باختفاء كمال جبروني وأن جميع هذه الخطوات باءت بالفشل.

Accordingly, the Committee considers that the examination of Kamel Djebrouni's case by the Working Group on Enforced or Involuntary Disappearances does not render it inadmissible under this provision.
وبالتالي، ترى اللجنة أن نظر الفريق العامل المعني بحالات الاختفاء القسري أو غير الطوعي في قضية كمال جبروني لا يجعل البلاغ غير مقبول بمقتضى هذه المادة.

It notes in the instant case that Kamel Djebrouni was arrested on 20 November 1994 and that his fate is still unknown.
وتلاحظ في هذا الصدد أن كمال جبروني اعتقل في 20 تشرين الثاني/نوفمبر 1994 وأن مصيره لا يزال مجهولاً إلى يومنا هذا.

3.6 The author also claims that, as a victim of enforced disappearance, Kamel Djebrouni was denied the protection of the law, in violation of article 16 of the Covenant.
