Although Djillali Larbi's family repeatedly contacted the competent authorities concerning his disappearance, the State party failed to conduct a thorough and rigorous investigation into the disappearance of the author's father, even though serious allegations of enforced disappearance were involved.
وعلى الرغم من أن أسرة جيلالي العربي أخطرت السلطات المختصة مراراً باختفائه، فإن الدولة الطرف لم تجر أي تحقيق معمّق ودقيق في اختفاء والد صاحب البلاغ والحال أن الأمر يتعلق بمزاعم خطيرة متصلة بالاختفاء القسري.

The Committee concludes that Djillali Larbi's enforced disappearance since 25 May 1994 denied him the protection of the law and deprived him of his right to recognition as a person before the law, in violation of article 16 of the Covenant.
وتخلص اللجنة إلى أن اختفاء جيلالي العربي قسراً منذ ما يقرب منذ 25 أيار/مايو 1994 حرمه من حماية القانون ومن حقه في أن يُعترف له بشخصيته القانونية، وفي ذلك انتهاك للمادة 16 من العهد.

The author maintains that, since all domestic remedies have proved ineffective and useless, and since Djillali Larbi's relatives are now legally deprived of their right to seek justice, he is no longer obliged to continue to seek domestic remedies and risk criminal prosecution in order to ensure that this communication is admissible before the Committee.
ويدفع صاحب البلاغ بأنه لم يعد ملزماً، لأغراض مقبولية هذا البلاغ أمام اللجنة، بمواصلة الإجراءات والتدابير على الصعيد المحلي، والتعرض من ثم لخطر الملاحقة جنائياً، ما دامت جميع سبل الانتصاف المحلية باءت بالفشل ولم تجد نفعاً وما دام أقارب جيلالي العربي قد باتوا محرومين قانوناً من حقهم في اللجوء إلى العادلة.

It also notes that Djillali Larbi's wife was interviewed on 11 January 2011 by the public prosecutor of Tiaret and that, on 9 February 2011, two witnesses were interviewed by the Family Affairs Section of the prosecution service of Tiaret, but that there was no follow-up.
وتلاحظ كذلك أن وكيل الجمهورية في محكمة تيارت استمع إلى زوجة جيلالي العربي في 11 كانون الثاني/يناير 2011 وأن قسم شؤون الأسرة التابع لنيابة تيارت استمع إلى شاهدين في 9 شباط/فبراير، دون أن يستتبع ذلك اتخاذ أي إجراء.

In view of Djillali Larbi's incommunicado detention and in the absence of information provided by the State party in that regard, the Committee finds a violation of article 10, paragraph 1, of the Covenant.
