Nevertheless, we find it proper to quote also a particularly articulate minority opinion, also written in the framework of domestic constitutional law rather than international law:

It should also be noted that the concern which was expressed by a number of States at the Vienna Conference, that the possibility of modifying a treaty by subsequent practice could create difficulties for domestic constitutional law, can no longer be simply dismissed.
وتجدر الإشارة أيضا إلى أنه لم يعد من الممكن تجاهل القلق الذي أعرب عنه عدد من الدول في مؤتمر فيينا من أن إمكانية تعديل معاهدة ما بفعل الممارسة اللاحقة يمكن أن يسبب صعوبات للقانون الدستوري المحلي().

In that paragraph, the Committee states: " Article 2 allows a State Party to pursue this in accordance with its own domestic constitutional structure and accordingly does not require that the Covenant be directly applicable in the courts, by incorporation of the Covenant into national law. "
ففي تلك الفقرة، تقول اللجنة ما يلي: " تتيح المادة 2 للدولة الطرف أن تقوم بذلك وفقاً لنظامها الدستوري المحلي الخاص بها، ولا تشترط بالتالي وجوب تطبيق أحكام العهد مباشرة في المحاكم، عن طريق إدراج تلك الأحكام في القانون الوطني " .

The Committee recalls, however, in this connection its general comment No. 31, according to which a State party is allowed, under article 2, to give effect to the Covenant rights in accordance with its own domestic constitutional structure and that it does not require that the Covenant be directly applicable in the courts, by incorporation of the Covenant into national law.
لكنها تذكّر في هذا الصدد بتعليقها العام رقم 31 الذي يفيد بأن المادة 2 تجيز للدولة الطرف إنفاذ الحقوق المنصوص عليها في العهد وفقاً للهيكل الدستوري المحلي الخاص بها، ولا تشترط تطبيق أحكام العهد مباشرة في المحاكم، عن طريق إدراج تلك الأحكام في القانون الوطني().

Such decision was taken in 1993, and although the constitutionality of the measure was contested, it was, for the purposes of domestic constitutional law, as distinct from compliance with the Covenant, upheld by the Supreme Court in the case of People v. Echegaray (GR No. 117472, judgement of 7 February 1997).
