70. This should be Cambodia's first serious attempt at dealing with the crimes that were committed during the Period of Democratic Kampuchea and with the legacy of its recent past.

This principle would mean that, if war crimes were included in the jurisdiction of a court for Cambodia, it would have to include war crimes by persons from other States during the Period of Democratic Kampuchea.

1. Approves the draft Agreement between the United Nations and the Royal Government of Cambodia concerning the Prosecution under Cambodian Law of Crimes Committed during the Period of Democratic Kampuchea contained in the annex to the present resolution;
1 - توافق على مشروع الاتفاق بين الأمم المتحدة وحكومة كمبوديا الملكية بشأن المقاضاة بموجب القانون الكمبودي على الجرائم المرتكبة خلال فترة نظام كمبوتشيا الديمقراطية الوارد في مرفق هذا القرار؛

The agreement between the United Nations and the Government of Cambodia concerning the prosecution under the Cambodian law of crimes committed during the Period of Democratic Kampuchea was signed in Phnom Penh on 6 June 2003.
وقد تم التوقيع في فنوم بنه في 6 حزيران/يونيه 2003 على الاتفاق المعقود بين الأمم المتحدة وحكومة كمبوديا بشأن المحاكمات بموجب القانون الكمبودي فيما يتعلق بالجرائم التي ارتُكِبت خلال فترة نظام كمبوتشيا الديمقراطية.

According to the Cambodian authorities, the Agreement between the United Nations and the Royal Government of Cambodia concerning the Prosecution under Cambodian Law of Crimes Committed during the Period of Democratic Kampuchea was to be submitted for ratification by the relevant Cambodian constitutional authorities as a matter of priority.

I have the honour to refer to General Assembly resolution 57/228 of 18 December 2002, in which the General Assembly requested me to resume negotiations, without delay, to conclude an agreement with the Government of Cambodia on the establishment of Extraordinary Chambers within the existing court structure of Cambodia for the prosecution of crimes committed during the Period of Democratic Kampuchea.

105. The Royal Government will continue to find justice for Cambodians through its support for the existing Extraordinary Chambers in the Courts of Cambodia in order to trial key Khmer Rouge leaders, most responsible for crimes committed during the Period of Democratic Kampuchea.
105- وستواصل الحكومة السعي إلى تحقيق العدالة لمواطني كمبوديا من خلال دعمها للدوائر الاستثنائية في المحاكم الكمبودية، بغرض محاكمة القيادات البارزة للخمير الحمر، التي تتحمل القدر الأكبر من المسؤولية عن الجرائم المرتكبة خلال فترة حكم كمبوتشيا الديمقراطية.

Welcoming in particular the promulgation of the Law on the Establishment of the Extraordinary Chambers in the Courts of Cambodia for the Prosecution of Crimes Committed during the Period of Democratic Kampuchea, and noting with appreciation the general provisions and competence of the Law and its provision for a role for the United Nations,

WHEREAS the General Assembly of the United Nations, in its resolution 57/228 of 18 December 2002, recalled that the serious violations of Cambodian and international humanitarian law during the Period of Democratic Kampuchea from 1975 to 1979 continue to be matters of vitally important concern to the international community as a whole;

The Government has also made efforts, in agreement with the United Nations, to establish the Extraordinary Chambers in the Courts of Cambodia for the prosecution of crimes committed during the Period of Democratic Kampuchea.
كما أن الحكومة بذلت جهوداً، بالاتفاق مع الأمم المتحدة، من أجل إنشاء دوائر استثنائية في محاكم كمبوديا للمحاكمة على الجرائم التي ارتكبت خلال فترة كمبوتشيا الديمقراطية.

After many years of negotiation, an agreement between the United Nations and the Government of Cambodia concerning the prosecution under Cambodian law of crimes committed during the Period of Democratic Kampuchea was signed in Phnom Penh on 6 June 2003.

The mission reached " substantial " agreement with the Government Task Force on several issues, including on staffing and the sequencing of work to prepare for the phased establishment of the Extraordinary Chambers, which will prosecute crimes committed during the Period of Democratic Kampuchea under Cambodian law.
وتوصلت البعثة إلى اتفاق " موضوعي " مع الفريق العامل الحكومي بشأن عدد من القضايا بما فيها ملاك الموظفين وتسلسل العمل التحضيري للإنشاء التدريجي للدوائر الاستثنائية التي ستجرى في إطارها المحاكمة على الجرائم المرتكبة خلال فترة كمبوتشيا الديمقراطية في ظل القانون الكمبودي.

44. Another of the recommendations was for the United Nations, in cooperation with the Cambodian Government and the non-governmental sector, to encourage a process of reflection among Cambodians to determine the desirability and, if appropriate, the modalities of a truth-telling mechanism to provide a fuller picture of the atrocities committed during the Period of Democratic Kampuchea.
٤٤ - ومن التوصيات اﻷخرى للفريق أن تقوم اﻷمم المتحدة، بالتعاون مع الحكومة الكمبودية والقطاع غير الحكومي، بتشجيع الكمبوديين على التفكير في مدى استصواب إنشاء آلية لكشف الحقيقة ووضع طرائق القيام بذلك عند الاقتضاء، لتقديم صورة كاملة عن اﻷعمال الوحشية التي ارتكبت في عهد كمبوتشيا الديمقراطية.

8.
