The need for such protection has been recognized in relevant international instruments which make it a duty for States parties to adopt legislative, administrative and other measures to ensure adequate protection to the family and its unity, either directly or through support to the activities of the relevant social institutions.
وقد اعترف بالحاجة إلى هذه الحماية في الصكوك الدولية ذات الصلة، التي تنص على أن من واجبات الدول اﻷطراف اتخاذ تدابير تشريعية وإدارية وغيرها من التدابير لضمان الحماية الملائمة لﻷسر وترابطها، سواء بشكل مباشر أو من خلال دعم أنشطة المؤسسات الاجتماعية ذات الصلة.

4. Reaffirms that the promotion of international cooperation is a duty for States, and that it shall be implemented without any conditionality, and on the basis of mutual respect, in full compliance with the principles and purposes of the Charter of the United Nations, in particular respect for the sovereignty of States, and taking into account national priorities;
4- يؤكد مجدداً أن تعزيز التعاون الدولي واجب من واجبات الدول وأنه يجب القيام به دونما قيد أو شرط وعلى أساسٍ الاحترام المتبادل والامتثال التام لمبادئ ومقاصد ميثاق الأمم المتحدة، ولا سيما احترام سيادة الدول ووضع الأولويات الوطنية في الاعتبار؛

4. This statement affirms that jurisprudence of many human rights bodies, which increasingly attaches importance to the view that effective remedies imply a right of the victims and not only a duty for States.
ويؤكد هذا القولُ الاجتهادَ القضائي للعديد من هيئات حقوق الإنسان الذي يولي أهمية بشكل متزايد لاعتبار أن سبل الانتصاف الفعالة تعني ضمنا وجود حق للضحايا، لا وجود واجب على الدول فحسب.

٥٥ - وذكر أن المادة ٢٠ تمثل حكما معتادا لمنع التمييز؛ إلا أنها لا تقرر أي واجب على الدول بأن تضمن الحق في الجبر، بل لا تقرر الحق في التمكن من الالتجاء إلى المحاكم الوطنية القادرة على الفصل في الموضوع؛ وأشير إلى أن ذلك إغفال ينبغي تداركه.
