تضمن كل دولة طرف قيام سلطاتها المختصة بإجراء تحقيق سريع ونزيه كلما وُجدت أسباب معقولة تدعو إلى الاعتقاد بأن عملاً من أعمال التعذيب قد ارتُكب في أي من الأقاليم الخاضعة لولايتها القضائية.

2- تكفل كل دولة طرف أن تُسجَّل جميع الرخص والتصاريح الصادرة للشركات العسكرية والأمنية الخاصة وموظفيها في السجل العام للدولة وأن تُمنح بناء على إجراءات شفافة ومفتوحة.

- تكفل كل دولة طرف أن يكون موظفو الشركات العسكرية والأمنية الخاصة مدرَّبين تدريباً مهنياً على احترام القانون الدولي لحقوق الإنسان والقانون الإنساني الدولي ذوي الصلة.

- each State Party shall ensure that PMSC personnel are professionally trained and vetted according to the applicable international standards, in particular regarding the use of specific equipment and firearms.
- تكفل كل دولة طرف أن يكون موظفو الشركات العسكرية والأمنية الخاصة مدرَّبين تدريباً مهنياً ومجازين وفقاً للمعايير الدولية السارية، ولا سيما فيما يتعلق باستخدام معدات وأسلحة نارية بعينها.

٢ - بالاضافة الى التدابير المتخذة عملا بالمادة ٧ من هذا البروتوكول ، يتعين على كل دولة طرف أن تكفل احتواء اطارها التشريعي على تدابير تتيح ، في الحالات المناسبة ، توفير ما يلي :

1. each State Party shall ensure that its legislative framework contains measures that, in appropriate cases, provide victims of trafficking in [women and children] [persons] with access to adequate procedures for seeking:
١ - على كل دولة طرف أن تكفل احتواء اطارها التشريعي على تدابير توفر لضحايا الاتجار ]بالنساء واﻷطفال[ ]باﻷشخاص[ ، في الحالات المناسبة ، سبل الوصول الى الاجراءات الملائمة لالتماس :
