The Convention prohibits any distinction, exclusion or restriction made on the basis of sex, which has the effect or purpose of impairing or nullifying the enjoyment and exercise of rights by women on an equal basis with men.
وتحظر الاتفاقية أي تفرقة أو استبعاد أو تقييد يتم على أساس الجنس، ويكون من آثاره أو أغراضه النيل من تمتع المرأة وممارستها لحقوقها على قدم المساواة مع الرجل أو إبطال هذه الحقوق.

Consequently, we consider that claims of succession to such titles of nobility are not compatible with the provisions of the Convention, which are aimed at protecting women from discrimination which has the effect or purpose of impairing or nullifying the recognition, enjoyment or exercise by women on a basis of equality of men and women, of human rights and fundamental freedoms in all fields.

This is to be distinguished from discrimination of women which has the effect or purpose of impairing or nullifying the recognition, enjoyment or exercise by women of human rights and fundamental freedom in the political, economic, social, cultural, civil or any other field as stipulated in article 1 of CEDAW.

The Committee has explained that application of the Convention to gender-based discrimination falls under the definition of discrimination contained in article 1, which points out that any distinction, exclusion or restriction which has the effect or purpose of impairing or nullifying the recognition, enjoyment or exercise by women of human rights and fundamental freedoms is discrimination.

فذلك التعريف يشير إلى أن أي تفرقة أو استبعاد أو تقييد يكون من آثاره أو أغراضه النيل من الاعتراف للمرأة بحقوق الإنسان والحريات الأساسية أو إبطال الاعتراف لها بتلك الحقوق أو تمتعها بها وممارستها لها، تعد تمييزاً حتى إن لم يكن التمييز مقصوداً.

Article 1 of the Convention clarifies the term sex by stating that the conduct to be prohibited is that conduct which " has the effect or purpose of impairing or nullifying, the recognition, enjoyment or exercise by women ... of human rights and fundamental freedoms. "

This encompasses any difference in treatment - by way of distinction, exclusion or restriction - on the grounds of sex that has the effect or purpose of impairing or nullifying the recognition, enjoyment or exercise by women, irrespective of their marital status, on a basis of equality with men, of their human rights and fundamental freedoms in all spheres of life.

For the purposes of the present Convention, the term `discrimination against women'shall mean any distinction, exclusion or restriction made on the basis of sex which has the effect or purpose of impairing or mollifying the recognition, enjoyment or exercise by women, of human rights and fundamental freedoms in the political, economic, social, cultural, civil or any other field.

Legislators have been urged to define " discrimination against women " as any distinction, exclusion or restriction on the basis of sex that has the effect or purpose of impairing or nullifying the recognition, enjoyment or exercise by women, irrespective of their marital status, on the basis of the equality of men and women, of their human rights and fundamental freedoms in the political, economic, social, cultural, civil or any other field.
وتم حث المشرعين على تعريف " التمييز ضد المرأة " بأنه كل تفرقة أو استبعاد أو تقييد يتم على أساس الجنس ويكون من آثاره أو أغراضه عرقلة أو إبطال الاعتراف للمرأة بحقوق الإنسان والحريات الأساسية في الميادين السياسية والاقتصادية والاجتماعية والثقافية والمدنية أو في أي ميدان آخر، أو توهين أو إحباط تمتعها بهذه الحقوق أو ممارستها لها، بصرف النظر عن حالتها الزوجية وعلى أساس المساواة بينها وبين الرجل.

8.6 The Committee recalls that article 1 of the Convention defines discrimination against women as " any distinction, exclusion or restriction made on the basis of sex which has the effect or purpose of impairing or nullifying the recognition, enjoyment, or exercise by women ... of human rights and fundamental freedoms in the political, economic, social, cultural, civil or any other field " .

11. Discrimination against women is defined in article 1 of the Convention as " any distinction, exclusion or restriction made on the basis of sex which has the effect or purpose of impairing or nullifying the recognition, enjoyment or exercise by women, irrespective of their marital status, on a basis of equality of men and women, of human rights and fundamental freedoms in the political, economic, social, cultural, civil or any other field " .
