With regard to communication No. 1107/2002, the Libyan consulate in Morocco had issued a passport to Ms. Loubna El Ghar.
وفيما يخص البلاغ رقم 1107/2002، قال إن القنصلية الليبية في المغرب قد أصدرت وثيقة سفر للسيدة لبنى الغار.

However, after receipt of that document, Ms. El Ghar had established no further contact with the consulate.
غير أن السيدة الغار بعد حصولها على هذه الوثيقة لم تُجر أي مزيد من الاتصالات بالقنصلية.

The issuance of a passport valid for two years to Ms. El Ghar was thus in accordance with the law, and not an act of discrimination.
ومن ثم فإن إصدار جواز سفر صالح لمدة سنتين للسيدة الغار يتوافق مع القانون ولا يُعتبر عملاً ينطوي على التمييز.

Ms. El Ghar had been asked to submit passport photographs and some additional documentation; her failure to do so had delayed the processing of the application.
وطُلِب إلى السيدة الغار تقديم صور فوتوغرافية لإصدار جواز السفر وبعض الوثائق الإضافية؛ غير أن عدم قيامها بذلك قد أدى إلى تأخير النظر في الطلب.

Two days after her initial application, Ms. El Ghar had returned to the consulate to request a document enabling her to travel to the Libyan Arab Jamahiriya, which she had been given.
وبعد مرور يومين من طلبها الأولي عادت السيدة الغار إلى القنصلية وطلبت وثيقة تمكِّنها من السفر إلى الجماهيرية العربية الليبية وحصلت عليها.

The State party representative noted that the Libyan embassy in Morocco had once again been instructed to issue a passport to the author; he expressed confidence that a passport would be issued to Ms. El Ghar within weeks.
فأشار ممثل الدولة الطرف إلى أن السفارة الليبية في المغرب قد تلقت مرة أخرى تعليمات بإصدار جواز سفر لصاحبة البلاغ؛ وأعرب عن ثقته في إصدار جواز سفر للسيدة الغار في غضون أسابيع.

Ms. FOX (Petitions team), referring to El Ghar v. Libyan Arab Jamahiriya (communication No. 1107/2002), said Ms. El Ghar had recently informed the Committee that she had received her passport.

The General Directorate had reconfirmed its decision to grant Ms. El Ghar's request in September 2003 and the passport had been issued once she had submitted all necessary documentation.
وقد أكدت المديرية العامة مرة أخرى قرارها بالموافقة على طلب السيدة الغار في أيلول/سبتمبر 2003 وقد أُصدِر جواز السفر ما أن قدمت جميع الوثائق اللازمة.

4.5 Lastly, the State party explains that instructions were sent on 1 July 2003 to the Brotherhood Bureau in Rabat to issue a passport to Ms. Loubna El Ghar.

4.2 On 6 September 2002, the Passport and Nationality Department asked the ConsulateGeneral to inform it whether the author had submitted an application for a passport, given that it had no record of any information concerning Ms. El Ghar.
4-2 وفي 6 أيلول/سبتمبر 2002، طلبت إدارة الجوازات والجنسية من القنصل العام إعلامها بما إذا كانت صاحبة الشأن قد قدمت طلباً للحصول على جواز سفر بما أن سجلاتها كانت خالية تماماً من أي معلومة تخص الآنسة الغار.

The HR Committee also recommended that the State follow-up on its views regarding communication 1107/2002 (Loubna El Ghar v. Libyan Arab Jamahiriya), relating to the issuance of a passport to a Libyan national abroad.
وأوصت اللجنة كذلك الدولة بمتابعة البلاغ رقم ١١٠٧/٢٠٠٢ (لُبنى الغار ضد الجماهيرية العربية الليبية)، المتعلق بإصدار جواز سفر لمواطنة ليبية مقيمة في الخارج.

In case No. 1107/2002 (El Ghar v. The Libyan Arab Jamahiriya) the author, a Libyan citizen, claimed that the refusal by the Libyan Consulate in Casablanca to issue her with a passport prevented her from travelling and studying abroad and constituted a violation of the Covenant.
168- في القضية رقم 1107/2002 (الغار ضد الجماهيرية العربية الليبية)، ادعت صاحبة البلاغ، وهي مواطنة ليبية، أن رفض القنصلية الليبية في الدار البيضاء منحها جواز سفر يمنعها من السفر إلى الخارج قصد الدراسة ويشكل انتهاكا للعهد.

In case No. 1107/2002 (El Ghar v. The Libyan Arab Jamahiriya), the Committee found a violation of article 12, paragraph 2, and decided that the State party was under an obligation to ensure that the author had an effective remedy, including compensation, and urged the State party to issue the author with a passport without further delay.
214- وفي القضية رقم 1107/2002 (الغار ضد الجماهيرية العربية الليبية)، تَبَيَّن للجنة أنه حدث انتهاك لأحكام الفقرة 2 من المادة 12، وقررت أن على الدولة الطرف أن تكفل لصاحبة البلاغ سبيل انتصاف فعالاً، بما في ذلك التعويض، وحثت الدولة الطرف على التعجيل بمنح صاحبة البلاغ جواز سفر.

The Committee, while noting that some clarification regarding communication No. 1107/2002 (Loubna El Ghar v. Libyan Arab Jamahiriya) was provided in the oral presentation of the delegation, regrets the failure of the State party to provide information concerning the implementation of the views of the Committee in communication No. 4407/1990 (Youssef El-Megreisi v. Libyan Arab Jamahiriya).

Please indicate what mechanisms are in place to give effect to the Committee's Views, including its Views regarding Communication No. 1107/2002 (Loubna El Ghar v. Libyan Arab Jamahiriya) and Communication no. 440/1990 (Youssef El-Megreisi v. Libyan Arab Jamahiriya).

Ms. MARKUS (Libyan Arab Jamahiriya) said that, when Ms. Loubna El Ghar (communication No. 1107/2002) had applied for a Libyan passport at the Libyan consulate in Casablanca (Morocco) on 16 September 2002, the consulate had taken the appropriate steps to request authorization from the relevant authorities.
