Having concluded its consideration of communication No. 1755/2008, submitted to the Human Rights Committee by Ashraf Ahmad El Hagog Jumaa, under the Optional Protocol to the International Covenant on Civil and Political Rights,
وقد فرغت من النظر في البلاغ رقم 1755/2008، الذي قدمه إليها السيد أشرف أحمد جمعة الحجوج بموجب البروتوكول الاختياري الملحق بالعهد الدولي الخاص بالحقوق المدنية والسياسية،

This being so, I cannot understand how the Committee can fail to find a violation of article 6 in the present case, El Hagog Jumaa v. Libya, when it has established that violations of articles 7 and 14 of the Covenant occurred in the course of the proceedings against Mr. Ashraf Ahmad El Hagog Jumaa.
وبناءً على ذلك، فإنه لا يمكنني أن أفهم كيف غاب عن اللجنة وجود انتهاك للمادة 6 في هذه القضية، الحجوج جمعة ضد ليبيا، حينما أثبتت حدوث انتهاكات للمادتين 7 و14 من العهد في إطار الإجراءات المتخذة ضد السيد أشرف أحمد الحجوج جمعة.

Accordingly, while acknowledging the commutation of the death sentence in the present instance, I consider that the Committee ought to have indicated that there was also a violation of article 6, paragraph 2, of the International Covenant on Civil and Political Rights in the El Hagog Jumaa case.
10- ومن ثم، فإنه مع إقراري بتخفيف حكم الإعدام في هذه الحالة، فإنني أرى أنه كان يتعين على اللجنة أن تشير إلى وقوع انتهاك آخر للفقرة 2 من المادة 6 من العهد الدولي الخاص بالحقوق المدنية والسياسية في قضية الحجوج جمعة.

10. 10- وبناءً عليه، إذ أقرّ بتخفيف حكم الإعدام في هذه الحالة، فإنني أرى أنه كان يتعين أيضاً على اللجنة أن تشير إلى وقوع انتهاك للفقرة 2 من المادة 6 من العهد الدولي الخاص بالحقوق المدنية والسياسية في قضية الحجوج جمعة.
