Article 5. Attribution to the State of the conduct of entities exercising elements of the governmental authority
المادة 5 - تحميل الدولة تصرفات الكيانات التي تمارس بعض اختصاصات السلطة الحكومية

Excess of authority or contravention of instructions The conduct of an organ of a State or of a person or entity empowered to exercise elements of the governmental authority shall be considered an act of the State under international law if the organ, person or entity acts in that capacity, even if it exceeds its authority or contravenes instructions.
يعتبر فعلا صادرا عن الدولة بمقتضى القانون الدولي تصرف جهاز من أجهزتها أو شخص أو كيان مخول صلاحية ممارسة بعض اختصاصات السلطة الحكومية إذا كان الجهاز أو الشخص أو الكيان يتصرف بهذه الصفة، حتى ولو تجاوز حدود سلطته أو خالف التعليمات.

The conduct of a person or group of persons shall be considered an act of a State under international law if the person or group of persons is in fact exercising elements of the governmental authority in the absence or default of the official authorities and in circumstances such as to call for the exercise of those elements of authority.
يعتبر فعلا صادرا عن الدولة بمقتضى القانون الدولي تصرف شخص أو مجموعة أشخاص إذا كان الشخص أو مجموعة الأشخاص يمارسون في الواقع بعض اختصاصات السلطة الحكومية في غياب السلطات الرسمية أو في حالة عدم قيامها بمهامها وفي ظروف تستدعي ممارسة تلك الاختصاصات.

The conduct of an organ which has been placed at the disposal of a State by another State or by an international organization shall be considered as an act of the former State under international law, if that organ was acting in the exercise of elements of the governmental authority of the State at whose disposal it has been placed.
يعتبر فعلا صادرا عن الدولة بمقتضى القانون الدولي تصرف أي جهاز تضعه دولة أخرى أو منظمة دولية تحت تصرفها، إذا كان تصرف هذا الجهاز ينطوي على ممارسة بعض اختصاصات السلطة الحكومية للدولة التي يكون الجهاز موضوعا تحت تصرفها.

The conduct of an entity which is not part of the formal structure of the State but which is empowered by the law of that State to exercise elements of the governmental authority shall also be considered as an act of the State under international law, provided the entity was acting in that capacity in the case in question.
يعتبر فعلا صادرا عن الدولة بمقتضى القانون الدولي أيضا تصرف أي كيان لا يشكل جزءا من البنية الرسمية للدولة ولكن يخوله قانون تلك الدولة صلاحية ممارسة بعض اختصاصات السلطة الحكومية شريطة أن يكون الكيان قد تصرف بهذه الصفة في الحالة المعنية.

يعتبر فعلا صادرا عن الدولة بمقتضى القانون الدولي تصرف أي جهاز تضعه دولة أخرى تحت تصرفها، إذا كان تصرف هذا الجهاز ينطوي على ممارسة بعض اختصاصات السلطة الحكومية للدولة التي يكون الجهاز موضوعا تحت تصرفها.

يعتبر فعلا صادرا عن الدولة بمقتضى القانون الدولي تصرف أي جهاز من أجهزتها أو أي كيان مخول صلاحية ممارسة بعض اختصاصات السلطة الحكومية يكون قد تصرف بهذه الصفة حتى ولو كان الجهاز أو الكيان قد تجاوز، في الحالة المعينة، حدود سلطته أو خالف التعليمات المتعلقة بممارسة هذه السلطة.

First of all, the term " elements of the governmental authority " is appropriate for States, but applies only in very limited cases to international organizations.

(b) The person or group of persons was in fact exercising elements of the governmental authority in the absence of the official authorities and in circumstances which called for the exercise of those elements of authority.
)ب( إذا كان الشخص أو الفريق من اﻷشخاص يمارس في الواقع بعض اختصاصات السلطة الحكومية في غياب السلطات الرسمية وفي ظروف استدعت ممارسة تلك الاختصاصات.

An international organization may also be, under the circumstances, as provided for in article 5, a " person or entity which is not an organ of the State under article 4 but which is empowered by the law of that State to exercise elements of the governmental authority " .

تسمح المادة 7 بأن يُعزى تصرف الأطراف الخاصة للدولة عندما تمارس الأطراف الخاصة " بعض اختصاصات السلطة الحكومية في غياب السلطات الرسمية أو في حالة عدم قيامها بمهامها وفي ظروف استدعت ممارسة تلك الاختصاصات " .
