In addition, it was observed that the cost of establishing and applying the regime envisaged in the draft Guide should also be discussed, at least with a view to addressing concerns that some States might have.
16- إضافة إلى ذلك، لوحظ أن تكلفة إنشاء وتطبيق النظام المتوخى في مشروع الدليل مسألة ينبغي مناقشتها أيضا، وذلك على الأقل بغية معالجة الشواغل المقلقة التي قد تكون لدى بعض الدول.

In that connection, it was stated that, whether the regime envisaged in the draft Guide would apply to security rights in immovables or not, the draft Guide needed to inform enacting States of the need to ensure that the secured transactions legislation would not overlap or be in conflict with other legislation.
وفي ذلك الصدد، ذُكر أنه سواء أكان من شأن النظام المتوخى في مشروع الدليل أن يُطبّق على الحقوق الضمانية في المنقولات أم لا، فان الحاجة تدعو إلى أن يبيّن مشروع الدليل للدول المشترعة ضرورة الحرص على عدم تداخل أو تنازع التشريع الخاص بالمعاملات المضمونة مع غيره من التشريعات.

It was also observed that the information provided in the encumbrance registry envisaged in the draft Guide would be either too much and thus raise issues of confidentiality and competition, or too little and thus be of no use.
وأبديت ملاحظة أيضا في أن المعلومات التي تُقدَّم في سجل الرهن المتوخى في مشروع الدليل إما قد تكون أكثر مما ينبغي ومن ثم تثير مسائل السرّية والمنافسة، وإما قد تكون أقل مما ينبغي ومن ثم تكون عديمة الفائدة.

It was stated that such a cooperation would allow an optimal use of resources and expertise available both in the field of substantive and conflict of laws rules that was necessary in order to prepare rules that would promote the economic objectives of the regime envisaged in the draft Guide.
وقيل إن هذا التعاون من شأنه أن يتيح استخداما أمثل للموارد والخبرة المتوافرة سواء في مجال القواعد الموضوعية أو قواعد تنازع القوانين، وهو ضروري لإعداد قواعد تعزز الأهداف الاقتصادية للنظام المتوخى في مشروع الدليل.

In response, it was stated that various approaches could be considered as long as they led to an acceptable practical result, keeping in mind that the regime envisaged in the draft Guide should include clear rules as to priority in proceeds (A/CN.9/WG.VI/WP.2/ Add.7, paras. 51-59).

After discussion, the Working Group decided to proceed with the examination of chapter V based on the working assumption that a publicity system, such as the one discussed in chapter V, would be part of the regime envisaged in the draft Guide.
67- وبعد المناقشة، قرر الفريق العامل المضيّ قدما بتمحيص الفصل الخامس بالاستناد إلى الافتراض المتّبع في العمل القائل بأن وجود نظام إشهار، على غرار النظام المناقش في الفصل الخامس، من شأنه أن يكون جزءا من نظام التقنين المتوخى في مشروع الدليل.

With respect to the title of the chapter, it was suggested that it should refer only to conflict of laws, since the function of conflict of laws rules in defining the territorial scope of application of substantive law regime envisaged in the draft Guide did not need to be highlighted in the title.
39- وفيما يتعلق بعنوان الفصل، اقتُرح أن يشير فقط إلى تنازع القوانين، بالنظر إلى أن وظيفة قواعد تنازع القوانين في تحديد النطاق الاقليمي لتطبيق القانون الموضوعي المتوخى في مشروع الدليل ليست بحاجة إلى إبرازها في العنوان.

With respect to the Convention and the Aircraft Protocol, however, it was observed that they involved a registry that was somehow different from the one envisaged in the draft Guide in that it would be international, asset-based (i.e. it would involve the identification of the encumbered asset, not the debtor, by a unique serial number) and referred only to high-value equipment.
أما بخصوص الاتفاقية وبروتوكول الطائرات، فقد لوحظ أنهما ينطويان على سجل يختلف إلى حد ما عن السجل المتوخى في مشروع الدليل من حيث إنه سوف يكون سجلا دوليا يستند إلى الموجودات المالية (أي إن من شأنه أن يشمل تحديد الموجودات الخاضعة للرهن، وليس المدين، برقم متسلسل فريد بذاته) وسوف لن يشير الا إلى المعدات العالية القيمة.

In that connection, it was stated that reference should be made, for example, to the appropriate infrastructure, judicial system and enforcement mechanisms necessary to ensure that a State enacting legislation based on the regime envisaged in the draft Guide ( " enacting State " ) could obtain the economic benefits referred to in the draft Guide (i.e. increased access to credit at the appropriate credit terms and cost).
