The location of equipment and technology supporting an information system could be used as an optional connecting factor to determine the place of business for those legal entities.
ويمكن استخدام مكان المعدات والتكنولوجيا الداعمة لنظام المعلومات كعامل ربط اختياري لتحديد مقرّات عمل تلك الكيانات الاعتبارية.

The Working Group agreed that it would be better to replace the current draft paragraph by a provision clarifying that the location of the equipment and technology supporting an information system was not a relevant criterion for the identification of the place of business.
واتفق الفريق العامل على أنه من الأفضل أن يستعاض عن مشروع الفقرة الحالي بحكم يوضح أن مكان المعدات والتكنولوجيا الداعمة لنظام المعلومات ليس معيارا ذا صلة في تحديد مقرّ العمل.

Paragraph 4 reflects that understanding by providing that the location of equipment and technology supporting an information system or the places from where the information system may be accessed by other parties do not by themselves constitute a place of business.
وتجسد الفقرة 4 هذا الفهم بالنص على أن مكان المعدات والتكنولوجيا الداعمة لنظام المعلومات، أو المكان الذي يمكن منه لأطراف أخرى أن تصل إلى نظام المعلومات، لا يشكل في حد ذاته مقر عمل.

In that connection, it was suggested that the words " the equipment and technology supporting an information system " should be replaced with words such as " the equipment and technology supporting the communications of the parties " .
108- واقتُرح في هذا الصدد أن يستعاض عن عبارة " المعدات والتكنولوجيا الداعمة لنظام المعلومات " بعبارة مثل " المعدات والتكنولوجيا الداعمة لاتصالات الطرفين " .

It was recalled that, according to Article 6 of the Electronic Communication Convention, the location of equipment and technology supporting an information system did not by itself establish the location of a contract, and by analogy the place of arbitration could not be ascertained from the location of the ODR provider or its equipment, which could indeed be located in a variety of jurisdictions simultaneously.
93- واستُذكر أنَّ المادة 6 من اتفاقية الخطابات الإلكترونية تنص على أنَّ مكان المعدات والتكنولوجيا الداعمة لنظام المعلومات لا يحدّد وحده مكان إبرام العقد، ونسجاً على هذا المنوال لا يمكن الاستدلال على مكان التحكيم على وجه اليقين من مكان وجود مقدّم خدمات التسوية أو معداته، التي يمكن أن تكون في الواقع موجودة في ولايات قضائية مختلفة في آن واحد.
