That was not the view of the European Commission on Human Rights, which, in its report, acknowledged that the deportation or extradition would under certain circumstances involve the responsibility of the deporting or extraditing Convention State if, for example, that State deported or extradited a person to a country where it was certain or where there was a serious risk that the person would be subjected to torture or inhuman treatment.

As to article 23, the authors refer to a decision of admissibility of the European Commission on Human Rights in Uppal v. United Kingdom, where the Commission, holding the case admissible, considered that issues arising under article 8 of the European Convention were complex and that their determination should depend on the merits.
