However, we do not concur with the Committee's statement that the authors' claim with regard to a violation of article 2, paragraph 2, read in conjunction with articles 19 and 21, is inadmissible in this case because an examination by the Committee of that argument " would [not] be distinct from the examination of a violation of the authors' rights under articles 19 and 21 of the Covenant " .

1.2 When registering the communication on 15 December 2011, and pursuant to rule 92 of its rules of procedure, the Committee, acting through its Special Rapporteur on new communications and interim measures, requested the State party not to carry out Mr. Kovalev's execution while his case was under examination by the Committee.

7.3 Apart from any violation of the Covenant found against a State party in a communication, a State party commits grave breaches of its obligations under the Optional Protocol if it acts so as to prevent or frustrate consideration by the Committee of a communication alleging a violation of the Covenant, or to render examination by the Committee moot and the expression of its Views nugatory and futile.
7-3 وبغض النظر عن أي انتهاك للعهد يلاحظ ضد دولة طرف في بلاغ ما، فإن الدولة الطرف تكون قد ارتكبت مخالفات خطيرة لالتزاماتها بموجب البروتوكول الاختياري إذا تصرفت على نحو يمنع أو يحبط نظر اللجنة في بلاغ يدعي حدوث انتهاك للعهد أو يجعل بحث اللجنة لهذا الأمر أو إبداء آرائها فيه عديم الأثر ولا جدوى منه.

1.2 On 2 June 2008, in accordance with article 92 of the Committee's rules of procedure, the Special Rapporteur on New Communications and Interim Measures requested the State party not to deport the author while his case was under examination by the Committee.
1-2 وفي 2 حزيران/يونيه 2008، وعملاً بالمادة 92 من النظام الداخلي للجنة، طلب المقرر الخاص المعني بالبلاغات الجديدة والتدابير المؤقتة من الدولة الطرف عدم ترحيل صاحب البلاغ ريثما تفرغ اللجنة من النظر في قضيته.

1.2 When registering the communication on 30 October 2009, and pursuant to rule 92 of its rules of procedure, the Committee, acting through its Special Rapporteur on new communications and interim measures, requested the State party not to carry out Mr. Zhuk's death sentence while his case was under examination by the Committee.
