الحرية الشخصية مكفولة ولا يجوز اتهام مواطن بارتكاب جريمة ولا تقيد حريته إلا بأمر من السلطات المختصة وفق ما جاء في هذا القانون.

ويحدد القانون الحالات التي تقيد فيها حرية المواطن التي لا يجوز تقييدها إلا بحكم من محكمة مختصة.

Article 11 of the Constitution guarantees that no person shall be subjected to torture, cruel, inhuman or degrading treatment or punishment while article 13, paragraph 4 provides that, no person shall be punished with death or imprisonment except by order of a competent court, made in accordance with procedure established by law.
وتكفل المادة 11 من الدستور عدم تعرض أي شخص للتعذيب أو للمعاملة أو العقوبة القاسية أو اللاإنسانية أو المهينة، بينما تنص الفقرة 4 من المادة 13 على عدم معاقبة أي شخص بالإعدام أو السجن إلا بأمر صادر عن محكمة مختصة وفقاً للإجراءات المكرسة قانوناً.

المادة 13(4)- حق الشخص الأساسي في عدم سجنه إلا بأمر من محكمة مختصة.

350. Following the promulgation of the Egyptian Constitution of 1971, the legislature introduced an amendment to article 40 of the Code of Criminal Procedure incorporating this constitutional right and stipulating that no person can be arrested or detained except by order of the authorities vested with legal competence in that respect.
351- وعقب صدور الدستور المصري عام 1971، قام المشرع بتعديل المادة 40 من قانون الإجراءات الجنائية بأن ضمَّنها هذا الحق الدستوري ونص على أنه لايجوز القبض على أي إنسان أو حبسه إلا بأمر من السلطات المختصة بذلك قانونا كما تجب معاملته بما يحفظ عليه كرامة الانسان ولايجوز إيذاؤه بدنيا أو معنويا0

Article 11 of the Code of Criminal Procedure stipulates that: " Personal freedom is guaranteed and a citizen may not be accused of the commission of an offence or have his freedom restricted except by order of the competent authorities as designated in this Code. "
وقد نص قانون الإجراءات الجزائية في المادة 11 منه على أن: " الحرية الشخصية مكفولة ولا يجوز اتهام مواطن بارتكاب جريمة ولا تقيد حريته إلا بأمر من السلطات المختصة وفق ما جاء في هذا القانون " .

56. Prevailing Qatari legislation prohibits and criminalizes torture and other practices which constitute ill-treatment or harsh punishment. According to the Code of Criminal Procedures, no one may be arrested or detained except by order of the competent authorities and under the conditions specified by law.
56- فقد وردت في التشريعات القطرية الجنائية النافذة نصوص تحظر وتجرم أفعال التعذيب والأفعال الأخرى التي تنم عن سوء المعاملة أو قسوة العقوبة، حيث ورد في قانون الإجراءات الجنائية بأنه " لا يجوز القبض على أي شخص أو حبسه إلا بأمر من السلطات المختصة بذلك وفي الأحوال المقررة قانوناً.

It stipulates that no person may be arrested or imprisoned except by order of the competent authority as set forth in law. He must be treated in a manner that preserves his dignity and shall not be physically or morally harmed.
" لا يجوز القبض على أحد أو حبسه إلا بأمر من الجهة المختصة بذلك قانونا، كما تجب معاملته بما يحفظ كرامته، ولا يجوز إيذاؤه بدنيا أو معنويا " .

But The Sunday Independent, on the basis of a letter faxed by Lindie Gouws, an administrator at Lindela, said that people are not detained at the Centre for more than one month, except by order of the High Court, and it is only in extreme cases that the Ministry of the Interior prolongs the period of detention to a maximum of 90 days.
بيد أن صحيفة " سانداي إندبندنت " أوردت نقلا عن رسالة فاكس من ليندي غاوس، موظفة إدارية في لينديلا، بأن " الأشخاص لا يُحتجزون في المركز لأكثر من شهر واحد إلا بأمر من المحكمة العليا، ولا تقوم وزارة الداخلية بتمديد فترة الاحتجاز لمدة أقصاها 90 يوما إلا في الحالات القصوى.

153. Arbitrary arrest, detention and deprivation of liberty are prohibited under the terms of article 14 of the Promotion of Freedom Act No. 20/1991. Articles 30 and 31 of the Code of Criminal Procedure incorporate the guarantees required by article 9, paragraph 1, of the Covenant. No one can be arrested except by order of the legally competent authorities (article 30).
٣٥١- فالتوقيف أو الاعتقال التعسفي أو الحرمان من الحرية محظور في حكم المادة ٤١ من القانون ٠٢/١٩ بشأن تعزيز الحرية، وتتضمن المادتان ٠٣ و١٣ من قانون اﻹجراءات الجنائية ذات الضمانات التي تحرص المادة ٩، الفقرة ١ من العهد على توافرها، فلا يجوز القبض على أي إنسان إلا بأمر من السلطات المختصة بذلك قانونا، المادة ٠٣ إجراءات.

108. Article 11 of the Code of Criminal Procedures No. 13 of 1994 states: " Personal freedom is guaranteed. No citizen may be charged with an offence or deprived of his liberty except by order of the competent authorities and in accordance with the present Code. "
108- كما نصت المادة 11 من قانون الإجراءات الجزائية رقم 13 لسنة 1994 أن " الحرية الشخصية مكفولة ولا يجوز اتهام مواطن بارتكاب جريمة ولا تقيد حريته إلا بأمر من السلطات المختصة وفق ما جاء في هذا القانون " .

202. Article 11 of the Code of Criminal Procedure (Act No. 13 of 1994) provides that " Personal freedom is guaranteed. No citizen may be charged with an offence or deprived of his liberty except by order of the competent authorities in accordance with the present Code. "
202- كما نصت المادة 11 من قانون الإجراءات الجزائية رقم 13 لسنة 1994 أن " الحرية الشخصية مكفولة ولا يجوز اتهام مواطن بارتكاب جريمة ولا تقيد حريته إلا بأمر من السلطات المختصة وفق ما جاء في هذا القانون " .

According to the Code of Criminal Procedure, no one may be arrested or detained except by order of the competent authorities and subject to the fulfilment of all the conditions specified by law. Moreover, all persons must be treated in a manner that preserves their human dignity, and no one may be subjected to physical or mental harm (art. 40).
وردت في التشريعات القطرية الجنائية النافذة نصوص تحظر وتجرم أفعال التعذيب والأفعال الأخرى التي تنم عن سوء المعاملة أو قسوة العقوبة، حيث ورد في قانون الإجراءات الجنائية بأنه لا يجوز القبض على أي شخص أو حبسه إلا بأمر من السلطات المختصة بذلك وفي جميع الأحوال المقررة قانوناً، كما تجب معاملته بما يحفظ عليه كرامة الإنسان ولا يجوز إيذاؤه بدنياً أو معنوياً المادة (40).

The Constitution guarantees the personal inviolability of citizens and undertakes to safeguard their dignity and security. The circumstances in which a citizen may be deprived of his liberty are defined by law and no one can be deprived of his liberty except by order of a competent tribunal.
83- ويكفل الدستور للمواطنين حريتهم الشخصية والمحافظة على كرامتهم وأمنهم ويحدد القانون الحالات التي تقيد فيها حرية المواطن ولا يجوز تقييد حرية أحد إلا بحكم من المحكمة المختصة.

34. Article 13.4 of the Constitution of Sri Lanka specifies that no person shall be punished with death or imprisonment except by order of a competent court.
٣٤- وتنص المادة١٣ )٤( من دستور سري لانكا على عدم معاقبة أي شخص باﻹعدام أو السجن إلا بحكم صادر من محكمة مختصة.
