فحين لا يشكل الكيان جزءاً من هيكل الدولة الـرسمي، فلربما اعتُبرت أفعاله أفعالاً للدولة متى خول القانون الداخلي للكيان ممارسة بعض اختصاصات السلطة الحكومية(5).

Similarly, article 5 provides that the conduct of a person or entity which is not an organ of the State under article 4, but which is empowered by the law of the State to exercise elements of governmental authority shall be considered as an act of the State under international law, provided that the person or entity in question was acting in that capacity in the instance in question.
