In support of that principle, the Special Rapporteur referred to the judgement of the European Court of Human Rights in Mubilanzila Mayeka and Kaniki Mitunga v. Belgium (2006), in which the Court recalled that in exercising their sovereign right to control their borders and the entry and stay of aliens, States must comply with their international obligations, including those established in the European Convention on Human Rights.
