Should a State Party that makes extradition conditional on the existence of a treaty receive a request for extradition from another State Party with which it has no extradition treaty, it may consider this Convention as the necessary legal basis for extradition with respect to the offence of forced disappearance.
٤- إذا أخضعت دولة طرف التسليم لشرط وجود معاهدة وتلقت طلب تسليم من دولة طرف أخرى لا تربطها بها معاهدة تسليم، يجوز لهذه الدولة أن تعتبر هذه الاتفاقية بمثابة اﻷساس القانوني اللازم للتسليم فيما يتعلق بجريمة الاختفاء القسري.

Moreover, the State party has not clarified whether it had invoked the Convention as a legal basis for extradition with regard to these crimes when it received a request for extradition from another State Party with which it has no extradition treaty.

4- يجوز لكل دولة طرف يكون التسليم فيها مرهوناً بوجود معاهدة أن تعتبر هذه الاتفاقية، عند تلقيها طلباً بالتسليم من دولة طرف أخرى لا تربطها بها معاهدة، بمثابة الأساس القانوني للتسليم فيما يتعلق بجريمة الاختفاء القسري.

4. If a State Party which makes extradition conditional on the existence of a treaty receives a request for extradition from another State Party with which it has no extradition treaty, it may consider [this instrument] as the necessary legal basis for extradition in respect of the offence of enforced disappearance.
4- يجوز لكل دولة طرف يكون التسليم فيها مرهوناً بوجود معاهدة أن تعتبر [هذا الصك]، عند تلقيها طلباً بالتسليم من دولة طرف أخرى لا تربطها بها معاهدة، بمثابة الأساس القانوني اللازم للتسليم في حالات الاختفاء القسري.
