The specific duty to ensure the protection of personnel, equipment and goods attached to relief operations did not overlap with the parallel though distinct obligation embodied in draft article 14, namely, the Facilitation of external assistance.

However, it was problematic that draft article 17 (Facilitation of external assistance) and draft article 18 (Protection of relief personnel, equipment and goods) failed to distinguish between emergency means with the potential to expedite the entry of relief personnel in a humanitarian crisis and development-related disaster preparedness.
واستدركت قائلة إن عدم تمييز مشروع المادة 17 (تيسير المساعدة الخارجية)، ومشروع المادة 18 (حماية موظفي الإغاثة ومعدات وسلع الإغاثة) بين وسائل مواجهة الطوارئ التي يمكنها الإسراع بدخول موظفي الإغاثة في الأزمات الإنسانية، والتأهب للكوارث ذي الصلة بالتنمية يطرح إشكالية.

The Drafting Committee, in the light of the discussion held by the Commission in plenary meeting, provisionally adopted the following five additional draft articles: 5 bis (Forms of cooperation), 12 (Offers of assistance), 13 (Conditions on the provision of external assistance), 14 (Facilitation of external assistance) and 15 (Termination of external assistance).

Draft articles 13 (Conditions on the provision of external assistance) and 14 (Facilitation of external assistance), as provisionally adopted by the Drafting Committee, were important from a practical point of view but might be difficult to implement in the case of a small State affected by a major disaster whose disaster management systems had shut down.
ورغم أن مشروعي المادتين 13 (شروط تقديم المساعدة الخارجية) و 14 (تيسير المساعدة الخارجية)، على النحو الذي اعتمدته لجنة الصياغة بصفة مؤقتة، يكتسبان أهمية من وجهة نظر عملية، فقد يكون من الصعب تنفيذهما في حالة دولة صغيرة متأثرة بكارثة كبيرة توقفت نظمها لإدارة الكوارث عن العمل.
