The Agreement requires flag States to maintain a record of fishing vessels entitled to fly their flag and authorized by them to fish on the high seas.
ويُلزم دول العلم بأن تحتفظ بسجل لسفن الصيد التي يحق لها رفع علمها والمرخص لها بالصيد في أعالي البحار.

Flag States should ensure that fishing vessels entitled to fly their flag do not fish on the high seas or under the jurisdiction of other States unless they have obtained both a Certificate of Registry and an authorization to fish.24

Unfortunately, some States allow vessels to fly their flag without ensuring that the fishing practices of those vessels are legal and sound.
فلسوء الطالع، تسمح بعض الدول للسفن بأن ترفع علمها دون أن تتأكد من أن هذه السفن تمارس صيد الأسماك بطريقة مشروعة وسليمة.

Until action is taken on the last point, small island developing States that are flag States are encouraged to consider declining the granting of the right to fly their flag to new vessels, suspending their registry or not opening a registry.

66. The United States expressed the view that all States had an obligation under international law, as reflected in the United Nations Convention on the Law of the Sea, to take measures to prevent fishing vessels entitled to fly their flag from fishing in zones under the jurisdiction of other States unless duly authorized to do so, and to ensure that such fishing was in accordance with applicable laws and regulations.

Calls upon States, in cooperation with the shipping industry, the insurance industry and the International Maritime Organization (IMO) to issue to ships entitled to fly their flag, appropriate advice and guidance within context of the Gulf of Guinea, on avoidance, evasion and defensive techniques and measures to take, if under the threat of attack, or attack when sailing in the waters of the Gulf of Guinea;

Urges States, as requested in particular by International Maritime Organization resolution ( " IMO " ) A-1002(25), to issue to ships entitled to fly their flag, as necessary, advice and guidance on appropriate precautionary measures to protect themselves from attack or actions to take if under attack or the threat of attack when sailing in waters off the coast of Somalia;

Many flag States take these responsibilities seriously, but there are some, often referred to as flags of convenience, who profit from allowing foreign ship operators to register vessels in their nation's name but fail to effectively monitor and oversee the ships which fly their flag.

41. Guidance promulgated by IMO advises governments to ensure that fishing vessels entitled to fly their flag do not engage in fishing activities within 200 miles off the coast of Somalia and calls upon Member States operating naval forces in the area to identify publicly any fishing vessels found to be doing so.
41 - وتنصح التوجيهات الصادرة عن المنظمة البحرية الدولية الحكومات بضمان عدم مشاركة سفن الصيد التي يحق لها أن ترفع علمها في أنشطة صيد ضمن مسافة 200 ميل من سواحل الصومال وتهيب بالدول الأعضاء التي لديها قوات بحرية في هذه المنطقة أن تحدد علناً سفن الصيد التي يتبين أنها تفعل ذلك.

In this regard, until such action is undertaken small island developing States flag States are encouraged to consider declining the granting of the right to fly their flag to new vessels, suspending their registry or not opening a registry.
