Accordingly, the Committee takes the view that it is not necessary to examine the general human rights situation in Honduras and that the claimant has not demonstrated that there are substantial grounds, in accordance with article 3 of the Convention, for believing that he would be in danger of being subjected to torture if he returned to his country of origin.

6.2 The Committee must determine whether the forced return of the complainant to Turkey would violate the State party's obligations under article 3, paragraph 1, of the Convention not to expel or return (refouler) an individual to another State where there are substantial grounds for believing that he would be in danger of being subjected to torture.
6-2 وعلى اللجنة أن تقرر ما إذا كانت الإعادة القسرية لمقدم الشكوى إلى تركيا ستشكل انتهاكاً لالتزام الدولة الطرف القائم بموجب الفقرة 1 من المادة 3 من الاتفاقية، بعدم طرد أي فرد أو إعادته إلى دولة أخرى، إذا توافرت أسباب جوهرية تدعو إلى الاعتقاد بأنه سيواجه خطر التعرض للتعذيب.

However, according to the State party, even if such a risk existed, it would not be sufficient to conclude that there were substantial grounds for believing that he would be in danger of being subjected to torture (communications Nos. 157/1996 and 65/1997).

١٧٨ - وينبغي للسلطات أن تأخذ باﻹجراءات التي تكفل بصورة فعلية ألا يطرد أحد الى بلد حيث تتوافر أسباب حقيقية تدعو الى الاعتقاد بأنه سيكون في خطر التعرض للتعذيب.

For the abovementioned reasons, the Committee finds that the petitioner has not provided substantial grounds for believing that he would be in danger of being tortured were he to be returned to Sri Lanka and that such danger is personal and present.
وللأسباب السالفة الذكر، ترى اللجنة أن مقدم البلاغ لم يقدم أسباباً قوية تدعو للاعتقاد بأنه سيكون في خطر التعرض للتعذيب إذا أُعيد إلى سري لانكا وبأن هذا الخطر شخصي وقائم.
