The Committee is nevertheless concerned by the fact that the State party, when it receives a request for extradition from another State party with which it has no extradition treaty, does not invoke the present Convention as a legal basis for extradition in respect of the crimes enumerated in article 4 of the Convention (art. 8).

2 - إذا تلقت دولة طرف، تجعل تسليم المجرمين مشروطا بوجود معاهدة، طلب تسليم من دولة طرف أخرى لا ترتبط معها بمعاهدة تسليم، جاز للدولة التي تتلقى الطلب أن تعتبر هذه الاتفاقية الأساس القانوني للتسليم فيما يخص الجرائم المعنية.

The Committee is however concerned by the fact that the State party, when the State party receives a request for extradition from another State with which it has no extradition treaty, does not invoke the present Convention as a legal basis for extradition in respect of the crimes enumerated in article 4 of the Convention (arts. 7, 8).
إلا أن اللجنة تشعر بالقلق لأن الدولة الطرف، عندما تتلقى طلباً بالتسليم من دولة أخرى لا تربطها بها معاهدة لتسليم المطلوبين، لا تحتج باتفاقية حظر التعذيب كأساس قانوني للتسليم فيما يخص الجرائم المنصوص عليها في المادة 4 من الاتفاقية (المادتان 7 و8).

The State party should take appropriate legislative and administrative measures to ensure that the present Convention can be invoked as a legal basis for extradition in respect of the crimes enumerated in article 4 of the Convention, when it receives a request for extradition from another State party with which it has no extradition treaty, while at the same time observing the provisions of article 3 of the Convention.
ينبغي للدولة الطرف أن تتخذ التدابير التشريعية والإدارية المناسبة التي تكفل التَذَرُّع بأحكام هذه الاتفاقية كأساس قانوني للتسليم فيما يختص بالجرائم المنصوص عليها في المادة 4 من الاتفاقية، عندما تتلقى طلباً بالتسليم من دولة طرف أخرى لم توقع معها معاهدة لتسليم المجرمين، وذلك مع مراعاة أحكام المادة 3 من الاتفاقية.
