2- يتعين على كل دولة طرف أن تسعى الى ضمان أن أية صلاحيات قانونية تقديرية يتيحها قانونها الداخلي فيما يتعلق بملاحقة الأشخاص لارتكابهم جرائم مشمولة بهذه الاتفاقية تُمارس من أجل تحقيق الفعالية القصوى لتدابير انفاذ القوانين التي تتخذ بشأن تلك الجرائم، ومع ايلاء الاعتبار الواجب لضرورة ردع ارتكابها.
