The question was raised generally as to the advisability of including in the Model Law a special method for procurement of services ( " request for proposals for services " ), the procedures for which were set forth in chapter IV bis, while, in accordance with article 16 (3) (b), also making available for the procurement of services the request for proposals procedures as set forth in article 38.

In pondering the above question, the Commission noted that the Working Group had considered, but had not been in a position to agree on, possible approaches other than the one embodied in the current draft, which made available for the procurement of services not only the procedures in chapter IV bis, but also the other procurement methods, in particular those referred to in article 17.

Paragraph 1 of the chapter on special service agreements of the UN-Women Programme and Operations Manual states that a special service agreement is a legal instrument used for the procurement of services provided by a person engaged by UN-Women, in his/her individual capacity, to provide expert services, advisory services, technical skills or knowledge for the performance of a specific task or piece of work.
٦٧ - تنص الفقرة 1 من الفصل المتعلق باتفاقات الخدمة الخاصة في دليل الهيئة للبرامج والعمليات على أن " اتفاق الخدمة الخاصة صك قانوني يُستخدم لشراء الخدمات التي يقدمها شخص تستعين به هيئة الأمم المتحدة للمرأة بصفته الفردية لتوفير خدمات الخبراء أو الخدمات الاستشارية أو المهارات أو المعارف التقنية اللازمة لأداء مهمة محددة أو عمل معين " .

99. It was suggested that, since the procurement of construction sometimes involved elements in the selection criteria that were similar to those for the procurement of services, the Guide should indicate that States might wish to consider using the provisions on procurement of services also for procurement of construction.
