Paragraph 115, subparagraph 1, of the Penal Code prohibits service in foreign armed forces in the following ways: A citizen of the Slovak Republic who without permission serves in the armed forces of a foreign power or in a foreign armed corps, shall be sentenced to imprisonment for a period from three to eight years.
فالفقرة الفرعية ١ من الفقرة ١١٥ من القانون الجنائي تحظر الخدمة في القوات المسلحة اﻷجنبية على النحو التالي: أي مواطن من مواطني الجمهورية السلوفاكية يقوم، دون إذن، بالخدمة في القوات المسلحة لدولة أجنبية أو في أي سلاح من أسلحة جيش أجنبي، يعاقب بالسجن لمدة تتراوح بين ٣ و ٨ سنوات.

75. Her Government believed that the issue of jurisdictional immunity of foreign armed forces should not be dealt with in the same manner as the jurisdictional immunity of other State organs.

The second argument for the maintenance of foreign armed forces and their installation on the territory of the Baltic States is in a curious way linked to human rights.

Therefore, the establishment of uniform multilateral rules covering civil jurisdictional immunity for foreign armed forces stationed in a host country could affect that bilateral balance, and the treatment to be accorded to the armed forces in question by virtue of those roles could be at variance with the nature of the bilateral relations existing between the two States.
والحال أن وضع قواعد متعددة اﻷطراف وموحدة فيما يتعلق بالحصانة من الولاية القضائية المدنية لصالح القوات المسلحة اﻷجنبية المرابطة في إقليم الدولة المضيفة يمكن أن يمس بهذا التوازن الذي أقيم على الصعيد الثنائي، كما يمكن أن تتعارض المعاملة التي تحصل عليها القوات المسلحة المعنية بموجب هذه القواعد مع طبيعة العلاقات الثنائية القائمة بين الدولتين.

(2) From a more practical point of view, it is to be pointed out that, since the hosting of foreign armed forces is often a highly controversial matter for the Host State, there may arise random proceedings against foreign armed forces in the Host State, in case the scope the principle of State immunity is applicable in should become limited under this Convention.

At its twenty-ninth session, in 1974, the General Assembly called upon all States to respect the sovereignty, independence, territorial integrity and non-alignment of the Republic of Cyprus and to refrain from all acts and interventions directed against it; and urged the speedy withdrawal of all foreign armed forces from Cyprus (resolution 3212 (XXIX)).

76. Therefore, establishing unified multilateral rules on the matter of jurisdictional immunity of foreign armed forces from civil proceedings in the host State, to which the draft articles might eventually contribute, could easily affect the balance of interests of the two States and bring about a situation in which the treatment of the armed forces in the host State did not reflect the overall bilateral relationship between the two States.
٧٦ - ولذلك، فإن وضع قواعد متعددة اﻷطراف موحدة بشأن حصانة القوات المسلحة اﻷجنبية من الولاية القضائية فيما يتعلق باﻹجراءات المدنية في الدولة المضيفة، التي قد تسهم فيها في النهاية مشاريع المواد، من شأنه أن يؤثر بسهولة في توازن المصالح بين الدولتين وأن يوجد حالة لا تعكس فيها معاملة القوات المسلحة في الدولة المضيفة مجمل العلاقات الثنائية بين الدولتين.

77. From a more practical point of view, it should be noted that, since the hosting of foreign armed forces was often a highly controversial matter for the host State, there might arise random proceedings against foreign armed forces in the host State, should the scope of applicability of the principle of State immunity be uniformly limited under the draft convention.
٧٧ - ومضت إلى القول إنه، من وجهة نظر أكثر عملية، ينبغي ملاحظة أنه نظرا لكون استضافة قوات مسلحة أجنبية إنما هي في الغالب مسألة تثير الجدل الشديد بالنسبة للدولة المضيفة، فمن المحتمل أن تثار اعتباطا دعاوى ضد القوات المسلحة اﻷجنبية في الدولة المضيفة، إذا كان نطاق انطباق مبدأ حصانة الدول ليكون محصورا على نحو موحد بموجب مشروع الاتفاقية.

20. In paragraph 41 of his report (E/CN.4/1999/31), the Special Rapporteur categorized the conflict in the Democratic Republic of the Congo as an internal conflict with the participation of foreign armed forces.
