The report comprises a thematic analysis by the Special Rapporteur of the integration of a human rights-based approach in measures to discourage the demand that fosters all forms of exploitation of persons, especially women and children, and which leads to human trafficking.

10. On 28 May, the Special Rapporteur presented her thematic report to the Human Rights Council at its twenty-third session, discussing the integration of a human-rights-based approach in measures to discourage the demand that fosters all forms of exploitation of persons, especially women and children, and that leads to human trafficking.

Article 9, paragraph 5, of the Protocol requires States parties to adopt or strengthen legislative or other measures, such as educational, social or cultural measures, including through bilateral and multilateral cooperation, to discourage the demand that fosters all forms of exploitation of persons, especially women and children, that leads to trafficking.

III. Integration of a human rights-based approach in measures to discourage the demand that fosters all forms of exploitation of persons, especially women and children, and which leads to human trafficking

58. The importance of bilateral and international cooperation in discouraging the demand that fosters all forms of exploitation of persons, especially women and children, that leads to trafficking has been noted in article 9 of the Trafficking Protocol.

61. At the global level, the mechanisms to enforce the Protocol obligations under article 9 on the prevention of human trafficking, including discouraging " the demand that fosters all forms of exploitation of persons, especially women and children, that leads to trafficking " , need to be further strengthened.

5. States Parties shall adopt or strengthen legislative or other measures, such as educational, social or cultural measures, including through bilateral and multilateral cooperation, to discourage the demand that fosters all forms of exploitation of persons, especially women and children, that leads to trafficking.

(a) At the end of the eleventh preambular paragraph, the words " that fosters all forms of exploitation of persons, especially women and children, and that thus promotes trafficking " were added;

6. Also urges Governments to adopt or strengthen legislative or other measures, such as educational, social or cultural measures, including through bilateral and multilateral cooperation, to discourage the demand that fosters all forms of exploitation of persons, especially women and children, and that leads to trafficking;
6- تحث أيضاً الحكومات على اعتماد أو تعزيز التدابير التشريعية أو غيرها من التدابير مثل التدابير التعليمية أو الاجتماعية أو الثقافية، ومنها التدابير التي تتخذ من خلال التعاون الثنائي والمتعدد الأطراف، لكبح الطلب الذي يشجع كل أشكال استغلال الأشخاص، ولا سيما النساء والأطفال، والتي تقود إلى الاتجار في الأشخاص؛

In its article 18, European Union directive 2011/36 on preventing and combating trafficking in human beings and protecting its victims similarly contains a provision to discourage and reduce the demand that fosters all forms of exploitation related to trafficking in human beings and requires Member States to consider taking measures to establish as a criminal offence knowingly using the services of victims of trafficking in persons.
37- وكذلك تتضمَّن المادة 18 من التوجيه الصادر عن الاتحاد الأوروبي 2011/36 بشأن منع ومكافحة الاتجار بالبشر وحماية ضحاياه، حكما مماثلا من أجل تثبيط وتقليل الطلب الذي يحفز جميع أشكال الاستغلال فيما يتعلق بالاتجار بالبشر، وتتطلب من الدول النظر في اتخاذ التدابير اللازمة لكي تُدرج في عداد الجرائم الجنائية الاستفادة عن علم بخدمات ضحايا الاتجار بالأشخاص.

Further research into factors that alleviate the need and desire to migrate in search of better conditions and factors that discourage demand that fosters all forms of exploitation of persons that leads to trafficking;

Many provisions of the Convention relate to children, among them article 6 which calls on States that adopt measures to discourage the demand that fosters all forms of exploitation of persons, especially women and children.
