1. Each State Party shall take appropriate measures to allow for identification, detection, freezing or seizure of any goods, funds or other means used or designed to be used in any manner in order to commit the offences referred to in this Convention, [as well as the proceeds derived from such offences,] for purposes of possible forfeiture.
١ - تتخذ كـل دولة طرف التدابير اللازمة لتحديد أو كشف أو تجميد أو حجز أي ممتلكات، وأموال وغير ذلك من الوسائل المستخدمة أو التي يعتزم استخدامها، بأي شكل من اﻷشكال، لارتكاب الجرائم المشار إليها في هذه الاتفاقية، ]وكذلك المواد التي يُحصل عليها من هذه الجرائم[ وذلك ﻷغراض مصادرتها عند الاقتضاء.

1. Each State Party shall take appropriate measures to allow for identification, detection, freezing or seizure of any goods, funds or other means used or designed to be used in any manner in order to commit the offences referred to in this Convention, for purposes of possible forfeiture.
١ - تتخذ كل دولة طرف التدابير اللازمة لتحديد أو كشف أو تجميد أو حجز أي ممتلكات، وأموال وغير ذلك من الوسائل المستخدمة أو التي يعتزم استخدامها، بأي شكل من اﻷشكال، لارتكاب الجرائم المشار إليها في هذه الاتفاقية، وذلك ﻷغراض مصادرتها عند الاقتضاء.

Angola indicated that the identification, tracing, freezing or seizure of items was only possible in relation to confiscation pronounced as an accessory sanction.
وأشارت أنغولا إلى أن تبيّن الأشياء الخاضعة للمصادرة أو اقتفاء أثرها أو تجميدها أو ضبطها غير ممكن إلا باقتران مع المصادرة التي تصدر بوصفها عقوبة ثانوية.

Jamaica reported that its domestic legislation permitted the identification, tracing, freezing or seizure of items liable to confiscation, but only in cases involving drug-related offences.
وأفادت جامايكا أن تشريعاتها الداخلية لا تسمح بتبيّن الأشياء الخاضعة للمصادرة أو اقتفاء أثرها أو تجميدها أو ضبطها إلا في سياق الحالات المتعلقة بالجرائم المتصلة بالمخدرات.

Cooperation is also possible for the enforcement of a foreign freezing or seizure and confiscation order.
والتعاون ممكن أيضاً في إنفاذ الأوامر الأجنبية الصادرة بشأن التجميد أو الحجز والمصادرة.

5. If such proceeds of crime have been intermingled with property acquired from legitimate sources, such property shall, without prejudice to any powers relating to freezing or seizure, be liable to confiscation up to the assessed value of the intermingled proceeds.
5- إذا خُلطت هذه العائدات الإجرامية بممتلكات اكتُسبت من مصادر مشروعة، وجب إخضاع تلك الممتلكات للمصادرة في حدود القيمة المقدّرة للعائدات المخلوطة، مع عدم المساس بأي صلاحيات تتعلق بتجميدها أو حجزها.

Australia indicated that its legislation was in full compliance with paragraph 2, concerning the identification, tracing, freezing or seizure of proceeds of crime for eventual confiscation, while Greece stated that it had not implemented the provision.
وبيّنت أستراليا أن تشريعها يمتثل تماما للفقرة 2 المتعلقة بكشف العائدات الإجرامية أو اقتفاء أثرها أو تجميدها أو حجزها بغرض مصادرتها في نهاية المطاف، في حين أفادت اليونان بعدم تنفيذها للحكم قيد الاستعراض.

2. States Parties shall adopt such measures as may be necessary to enable the identification, freezing or seizure of any item referred to in paragraph 1 of this article for the purpose of eventual confiscation.
٢ - تتخذ الدول اﻷطراف ما يلزم من تدابير للتمكين من كشف أو تجميد أو ضبط أي من اﻷشياء المشار إليها في الفقرة ١ من هذه المادة، بغية مصادرته في نهاية المطاف.

4. If proceeds of crime have been intermingled with property acquired from legitimate sources, such property shall, without prejudice to any powers relating to freezing or seizure, be liable to confiscation up to the assessed value of the intermingled proceeds.
4- إذا كانت العائدات الاجرامية قد اختلطت بممتلكات اكتسبت من مصادر مشروعة، وجب اخضاع تلك الممتلكات للمصادرة في حدود القيمة المقدرة للعائدات المختلطة، دون مساس بأي صلاحيات تتعلق بتجميدها أو ضبطها.

With regard to the freezing or seizure of property upon a foreign freezing or seizure order by a court or competent authority of a requesting State party (para. 2 (a)), Armenia, Azerbaijan and Serbia indicated full compliance.
وفيما يتعلق بتجميد أو حجز الممتلكات، بناء على أمر تجميد أو حجز صادر عن محكمة أو سلطة مختصة في الدولة الطرف الطالبة (الفقرة 2 (أ))، أشارت أرمينيا وأذربيجان وصربيا إلى الامتثال الكامل للحكم.

In conformity with these provisions, article 595-2 of Morocco's Code of Criminal Procedure confers on the judicial authorities the power to order the freezing or seizure of funds suspected of being connected with the financing of terrorism.

وتوضح الأعمال التحضيرية أنه يجوز في الحالة الأولى للدولة الطرف أن تختار اعتماد إجراءات إما للاعتراف بأمر التجميد أو الحجز الأجنبي وإنفاذه وإما لاستخدام ذلك الأمر كأساس لاستصدار أمر تجميد أو حجز خاص بها.

Jamaica reported that its domestic legislation contemplated the identification, tracing, freezing or seizure of items liable to confiscation only in offences related to drugs.
وأفادت جامايكا أن تشريعاتها الداخلية لا تنظر في تبيّن الأشياء الخاضعة للمصادرة أو اقتفاء أثرها أو تجميدها أو ضبطها إلا في سياق الجرائم المتصلة بالمخدرات.

The Summit further recommends that States should consider concluding agreements or arrangements on asset-sharing with countries involved in tracing, freezing or seizure and confiscation of assets originating from organized crime activities.
44- يوصي مؤتمر القمة كذلك بأن تنظر الدول في عقد اتفاقات أو ترتيبات بشأن اقتسام الأصول المالية مع البلدان المشاركة في تعقّب الأصول الناتجة عن أنشطة الجريمة المنظمة أو تجميدها أو ضبطها ومصادرتها.

(i) " Freezing " or " seizure " shall mean temporarily prohibiting the transfer, conversion, disposition or movement of property or temporarily assuming custody or control of property on the basis of an order issued by a court or other competent authority;
(ط) يقصد بتعبير " التجميد " أو " الحجز " فرض حظر مؤقت على احالة الممتلكات أو تحويلها أو التصرف فيها أو تحريكها، أو تولي حراستها أو مراقبتها مؤقتا بأمر صادر عن محكمة أو سلطة مختصة أخرى؛

The request for the freezing or seizure of funds issued by the requesting foreign authorities must reasonably substantiate that there exist sufficient grounds for taking such measures and that the funds or property in question will be subject to confiscation. In such cases the request must contain the following information:
ويجب أن يتوفر في طلب التجميد أو الحجز الصادر من السلطات الأجنبية الطالبة أساسا معقولا بأن هناك أسبابا كافية لاتخاذ تدابير من هذا القبيل وبأن تلك الأموال أو الممتلكات ستخضع للمصادرة على أن يتضمن الطلب في هذه الحالة المعلومات التالية:

On the basis of information cross-checked by the unit, the financial authorities will be able to order the freezing or seizure of funds of questionable origin.
واستنادا إلى المعلومات التي تحرت بشأنها، يمكن للسلطات المالية أن تأمر بتجميد أو حجز الأموال ذات المصدر المشبوه.

Angola and Kenya further indicated no compliance with paragraph 2, calling for the identification, tracing, freezing or seizure of proceeds of crime for eventual confiscation. Concerning the same provision, Mauritius, Morocco and Sierra Leone indicated partial compliance.
كما أشارت أنغولا وكينيا إلى عدم امتثالهما لأحكام الفقرة 2، التي تدعو إلى كشف العائدات الإجرامية أو اقتفاء أثرها أو تجميدها أو حجزها بغرض مصادرتها في نهاية المطاف، بينما أشارت سيراليون والمغرب وموريشيوس إلى امتثالها الجزئي لذلك الحكم.
