One member requested further explanation of article 406 of the Penal Code and requested information on what would happen in October when ONUSAL was to withdraw from the territory of the State party.
وطلب أحد اﻷعضاء مزيدا من اﻹيضاح للمادة ٤٠٦ من قانون العقوبات وطلب معلومات عما سيجري في شهر تشرين اﻷول/أكتوبــر عندمـا يترتـب على بعثة مراقبي اﻷمم المتحدة في السلفادور الانسحاب من أراضي الدولة الطرف.

(a) Ensure that migrant workers and members of their families are only expelled from the territory of the State party pursuant to a decision taken by the competent authority in conformity with the law;
(أ) العمل على ألا يطرد العمال المهاجرون وأفراد أسرهم من إقليم الدولة الطرف إلا بموجب قرار من السلطة المختصة وفقاً للقانون؛

(18) The Committee is concerned by the absence of a legal framework for the protection of migrants who do not satisfy the international refugee definition, but who face a real risk of death, torture or ill-treatment if expelled from the territory of the State party (arts. 6 and 7).
(18) وتشعر اللجنة بالقلق إزاء عدم وجود إطار قانوني لحماية المهاجرين الذين لا ينطبق عليهم التعريف الدولي للاجئ ولكنهم يواجهون خطراً حقيقياً يتمثَّل في تعرُّضهم للموت أو التعذيب أو سوء المعاملة إذا ما طُرِدوا من إقليم الدولة الطرف (المادتان 6 و7).

18- وتشعر اللجنة بالقلق إزاء عدم وجود إطار قانوني لحماية المهاجرين الذين لا ينطبق عليهم التعريف الدولي للاجئ ولكنهم يواجهون خطراً حقيقياً يتمثَّل في تعرُّضهم للموت أو التعذيب أو سوء المعاملة إذا ما طُرِدوا من إقليم الدولة الطرف (المادتان 6 و7).

(f) The number of child victims of trafficking - whether within the territory of the State party, from the territory of the State party to other States or from other States to the territory of the State party - including information as to the type of exploitation for which such children are trafficked (see annex); and
(و) عدد الأطفال ضحايا الاتجار، سواء داخل إقليم الدولة الطرف، أو من إقليم الدولة الطرف إلى دول أخرى، أو من دول أخرى إلى إقليم الدولة الطرف، بما في ذلك المعلومات المتعلقة بنوع الاستغلال الذي يتم الاتجار بهؤلاء الأطفال من أجله (انظر المرفق)؛

(a) Migrant workers and members of their families are only expelled from the territory of the State party pursuant to a decision taken by the competent authority following a procedure established by law and in conformity with the Convention, and that this decision can be reviewed on appeal;
(أ) عدم إبعاد العمال المهاجرين وأفراد أسرهم من أراضي الدولة الطرف إلا بقرارٍ تتَّخذه السلطات المختصَّة وفقـاً لإجراء يحدده القانون وعلى نحو يتماشى مع الاتفاقية، وإتاحة إمكانية إعادة النظر في هذا القرار بطلب الاستئناف؛

(30) The State party is invited to ensure that migrant workers and members of their families only be expelled from the territory of the State party pursuant to a decision taken by the competent authority in conformity with the law, and that this decision can be reviewed on appeal.
(30) تدعو اللجنة الدولة الطرف إلى كفالة ألا يُطرد العمال المهاجرون وأفراد أسرهم من أراضي الدولة الطرف إلا عملاً بقرارٍ تتَّخذه السلطات المختصَّة وفقاً للقانون، وأن يتسنَّى إعادة النظر في هذا القرار بطلب الاستئناف.

7.5 The Committee notes that counsel alleges a violation of article 12 of the Convention, since the State party did not conduct an investigation after the report was filed by Mr. Sørensen and Ms. Genefke on 5 August 2009 and since, moreover, the complainant was removed from the territory of the State party before any examination of the complaint that his detention constituted a violation of the Convention had taken place.
7-5 تلاحظ اللجنة أن المحامي يدعي حدوث انتهاك للمادة 12 من الاتفاقية نظراً لأن الدولة الطرف لم تجر تحقيقاً بعد التقرير الذي قدمه السيد سورينسن والسيدة غينيفكي في 5 آب/أغسطس 2009 ولأنه بالإضافة إلى ذلك نُقل صاحب الشكوى من أراضي الدولة الطرف قبل أي دراسة للشكوى التي تفيد بأن احتجازه يشكل انتهاكاً للاتفاقية.
