The second annex to the Agreement is devoted to the regulation of grazing rights and the movement and exploitation of water resources in the frontier zone. Article 1 thereof provides as follows: " For the purposes of this annex, the grazing area shall extend to a maximum depth of 25 kilometres from the joint border line into the territories of both countries. "
231- أما الملحق الثاني باتفاقية الحدود الدولية بين البلدين فقد وجه اهتماماً لتنظيم حقوق الرعي والتنقل والانتفاع من موارد المياه في منطقة الحدود، حيث تنص المادة 1 منه على أن تُحدّد منطقة الرعي لأغراض هذا الملحق بعمق خمسة وعشرين كليومتراً كحد أقصى من خط الحدود المشترك في أراضي كل من البلدين.

Annex No. 4 of the Agreement between the Republic of Yemen and the Kingdom of Saudi Arabia provides for the regulation of grazing rights and the delineation of locations for the stationing of armed forces along the two sides of the second part of the border line to which the Agreement refers. It also provides for the exploitation of joint natural resources along the continental border line between the two countries.
238- وقد تضمن الملحق رقم 4 لمعاهدة الحدود الدولية بين الجمهورية اليمنية والمملكة العربية السعودية تنظيم حقوق الرعي وتحديد تموضع القوات المسلحة على جانبي الجزء الثاني من خط الحدود بين البلدين المشار إليه في هذه المعاهدة واستغلال الثروات الطبيعية المشتركة على طول خط الحدود البرية الفاصلة بين البلدين.

In this context, it emphasizes that in both the " Korssjofjell Case " and the " Aursunden Case 1997 " , the Supreme Court found that the authors had not acquired grazing rights in the disputed area, i.e. the authors had never had such rights to the areas in question.
وفي هذا السياق تؤكد الدولة الطرف أنه في " قضية كورسجوفيجيل " و " قضية أورسوندن لعام ١997 " كلتيهما، رأت المحكمة العليا أن أصحاب البلاغ لم يكتسبوا حقوق الرعي في المنطقة موضع النـزاع أي أن أصحاب البلاغ لم يكن لهم قط مثل هذه الحقوق في المناطق موضع البحث.

4.12 In that connection, pursuant to the " Korssjofjell Case " in which the Supreme Court stated that the administrative designation of herding districts was not decisive for grazing rights under private law, the Reindeer Husbandry Act section 31 was amended in 1996.
٤-١٢ ويجدر بالذكر في هذا الصدد أنه وفقاً " لقضية كورسجوفيجيل " التي ذكرت فيها المحكمة العليا أن التسمية الإدارية لمناطق محددة للرعي لا تعتبر أمراً حاسماً لاكتساب حقوق الرعي بموجب القانون الخاص، عدل في عام ١99٦ البند ٣١ من القانون الخاص بتربية حيوانات الرنة.
