وفي 17 آذار/ مارس 2008، قرر أحد قضاة تلك المحكمة عدم قبول الطعن الخاص على أساس أن صاحبة البلاغ فاتها الموعد النهائي لتقديم الطعن.

7.3 The Committee notes that the State party has challenged the admissibility of the communication on the ground that the author has not requested the Prosecutor's Office to have his administrative case examined under the supervisory review proceedings and thus, according to the State party, the communication should be declared inadmissible for non-exhaustion of domestic remedies under article 5, paragraph 2 (b), of the Optional Protocol.
7-3 وتلاحظ اللجنة أن الدولة الطرف قد اعترضت على مقبولية البلاغ لأن صاحب البلاغ لم يطلب من مكتب المدعي العام إعادة النظر في دعوى المخالفة الإدارية في إطار إجراءات المراجعة القضائية وبالتالي فهي ترى أن البلاغ ينبغي أن يعتبر غير مقبول بسبب عدم استنفاد سبل الانتصاف المحلية حسبما تقتضيه الفقرة 2(ب) من المادة 5 من البروتوكول الاختياري.
