2.6 After lodging an appeal against this decision, Mohamed Hassan Aboussedra was retried on 2 June 2005, again behind closed doors but this time before an ordinary court, the People's Court having been abolished in January of that year.
2-6 وبعد أن طعن محمد حسن أبوسدرة في ذلك القرار، مَثُل مجدداً في جلسة مغلقة في 2 حزيران/يونيه 2005 أمام محكمة عادية، إذ كانت المحكمة الشعبية قد أُلغيت في شهر كانون الثاني/يناير من نفس السنة.

2.7 While his family were waiting for him to be released, they learned from former detainees of the same prison that Mohamed Hassan Aboussedra had been removed from Abu Salim prison by officers of the internal security forces on 9 June 2005.
2-7 وبينما كانت الأسرة تنتظر إطلاق سراحه، علمت من محتجزين كانوا في نفس السجن ثم أُفرج عنهم أن أفراداً من أجهزة الأمن الداخلي اقتادوا محمد حسن أبوسدرة من سجن أبو سليم في 9 حزيران/يونيه 2005.

3.9 As to the exhaustion of domestic remedies, the author refers to his father's numerous attempts to ascertain the fate or whereabouts of Mohamed Hassan Aboussedra.
3-9 وفيما يتعلق بمسألة استنفاد سبل الانتصاف المحلية، يذكّر صاحب البلاغ بالمساعي العديدة التي قام بها والده للكشف عن مصير محمد حسن أبوسدرة.

The Committee therefore concludes that the enforced disappearance of Mohamed Hassan Aboussedra during the greater part of his detention denied him the protection of the law for the same period and deprived him of his right to recognition as a person before the law, in violation of article 16 of the Covenant.

2.8 On 31 January 2007, the family learned that Mohamed Hassan Aboussedra was being detained incommunicado at the headquarters of the internal security forces in Tripoli, that the conditions of his detention were deplorable, and that he had been subjected to torture for several months, to the extent that his life was apparently in danger.
2-8 وفي 31 كانون الثاني/يناير 2007، علمت الأسرة أن محمد حسن أبوسدرة كان محتجزاً سراً في مقر الأمن الداخلي في طرابلس وبأن ظروف احتجازه سيئة للغاية وبأنه كان يتعرض فيها للتعذيب منذ عدة شهور لدرجة أن حياته باتت في خطر.

2.11 On 7 June 2009, more than 20 years after his arrest, Mohamed Hassan Aboussedra was released. However, he was forbidden to leave Tripoli.
2-11 وفي 7 حزيران/يونيه 2009، أُفرج عن محمد حسن أبوسدرة بعد مرور أكثر من عشرين سنةً على توقيفه لكنه مُنع من مغادرة طرابلس().

It notes that, like his four brothers, Mohamed Hassan Aboussedra was detained incommunicado in different places of detention, where he was subjected to torture from the time of his arrest on 19 January 1989 until his family was able to visit him in Abu Salim prison in April 1992.
وتلاحظ اللجنة أن محمد حسن أبوسدرة احتُجز سراً، مثله مثل إخوته الأربعة، منذ اعتقاله في 19 كانون الثاني/يناير 1989، في أماكن احتجاز مختلفة خضع فيها للتعذيب إلى أن سُمح له بتلقي زيارة أسرته في نيسان/أبريل 1992 في سجن أبو سليم.

7.5 With regard to the victim's wife, Selma Younès, and his two children, T.A. and A.A., the Committee notes the anguish and distress that they suffered as a result of the disappearance of Mohamed Hassan Aboussedra, about whom they were left without news between 1989 and 1992, and then for several years between 1995 and 2005.
7-5 أما فيما يخص زوجة الضحية، السيدة سلمى يونس، وولديهما، ت. أ. وآسية، فإن اللجنة تلاحظ القلق الشديد والمحنة التي تسبّب لهم فيها اختفاء محمد حسن أبوسدرة الذي انقطعت عنهم أخباره ما بين عامي 1989 و1992، ثم طيلـة عـدة سنوات ما بين عامي 1995 و2005.

7.8 Although the author does not invoke article 14 of the Covenant, the Committee is of the opinion that the information before it regarding the first sentence handed down against Mohamed Hassan Aboussedra in 2004 raises issues under article 14, paragraphs 1 and paragraph 3 (a) to (d), of the Covenant.
7-8 ومع أن صاحب البلاغ لم يستظهر بالمادة 14 من العهد، فإن اللجنة ترى أن المعلومات المعروضة عليها بشأن الحكم الأول الذي صدر في حق محمد حسن أبوسدرة في عام 2004 تثير قضايا تتعلق بالفقرة 1 والفقرة 3 (أ - د) من المادة 14 من العهد.

2.5 It was not until 2004, 15 years after his arrest, that Mohamed Hassan Aboussedra was brought before a court for the first time. The court in question -- the People's Court in Tripoli, a special court with jurisdiction to hear political cases -- sentenced him to life imprisonment.
2-5 ولم يمثُل محمد حسن أبوسدرة لأول مرة أمام المحكمة الشعبية في طرابلس، وهي محكمة عدل خاصة مكلفة بالحكم في القضايا السياسية()، إلاّ في عام 2004، أي بعد مرور 15 سنة على توقيفه، وحكمت عليه تلك المحكمة بالسجن المؤبد().

7.4 The Committee concludes, on the basis of the available evidence, that to have exposed the author's brother to acts of torture, to have kept him in captivity for more than 20 years, and to have prevented him from communicating with his family and the outside world constitutes a violation of article 7 of the Covenant in respect of Dr. Mohamed Hassan Aboussedra.
7-4 وتخلص اللجنة، استناداً إلى المعلومات المتوفرة لديها، إلى أن تعرّض الضحية لأعمال تعذيب وإبقاءه في الأَسر أزيد من 20 سنة ومنعه من الاتصال بأسرته وبالعالم الخارجي أمور تشكل انتهاكاً للمادة 7 من العهد في حق الدكتور محمد حسن أبوسدرة().

2.3 On 2 March 1995, after six years of incarceration, the victim's four brothers were released, without ever having appeared in court or had any judicial proceedings brought against them. However, Dr. Mohamed Hassan Aboussedra continued to be detained without judicial process, without access to legal counsel and without being able to challenge the lawfulness of his detention.
2-3 وفي 2 آذار/مارس 1995، أي بعد مرور ست سنوات على الاحتجاز، أُفرج عن إخوة الضحية الأربعة، دون أن يقدَّموا إلى العدالة ودون أن توجَّه إليهم أي تهم جنائية في حين أُبقي الدكتور محمد حسن أبوسدرة في السجن، دون أن تُرفع عليه أي دعوى قضائية ودون أن تتاح له إمكانية الاتصال بمحامٍ أو الطعن في مشروعية احتجازه.
