(ج) ثالثا، إن الدولة التي تلغي عقوبة الإعدام لا يجوز لها أن تسلم أو تطرد شخصا محكوما بعقوبة الإعدام إلى بلد دون أن تحصل على ضمانات مسبقة تتعلق بعدم تطبيق عقوبة الإعدام على هذا الشخص؛ غير أن هذا الالتزام لا يسري إلا على الدول التي ألغت عقوبة الإعدام.
