Prosecutions against police or prison officers or others found to have committed acts of torture should be initiated by prosecutors.

The State party should amend its legislation to ensure that persons who are alleged to have committed acts of torture are prosecuted under article 127 of the Criminal Code and that appropriate penalties for acts of torture are applied that are commensurate with the gravity of the crime, as set out in article 4, paragraph 2, of the Convention.
ينبغي أن تعدل الدولة الطرف تشريعاتها لكفالة ملاحقة الأشخاص الذين يُزعم أنهم ارتكبوا أعمال التعذيب بموجب المادة 127 من القانون الجنائي، وضمان فرض عقوبات مناسبة على أعمال التعذيب تتناسب وخطورة الجريمة، على النحو المبين في الفقرة 2 من المادة 4 من الاتفاقية.
